The Search for Answers in Fort Hood

The country is unpacking the recent shooting at Fort Hood and analyzing the perpetrator intensely. Along with natural shock and curiosity, a principle reason for doing so is to discover what can prevent incidents like this in the future.

When faced with any risk, including rampaging gunmen, there are four options:

(There is much more to risk management, of course. This handy simplification is taken from the DHS Privacy Committee’s “framework” document.)

Taking the facts as they appear now, what lessons can we take from Fort Hood that will help protect military forces and facilities, and the country in general? Let’s go through some of them option-by-option:

Prevention: What circumstances at Fort Hood and elsewhere could be altered to prevent this ever happening again? An obvious one is gun control—if there were no guns, there could be no shooting. But this prescription is complicated by the intrusions on individual rights required to implement it. Depriving citizens of arms directly violates the Second Amendment, and effectively enforcing a gun control regime would almost certainly violate the Fourth.

Removing guns from specific locations might be more palatable and achievable, but gun rampages do not restrict themselves to restricted areas, and widespread possession of guns by law-abiding citizens is an important form of interdiction. Indeed, appropriate gun violence was the interdiction that ultimately stopped further bloodshed.

Interdiction: What steps can be taken against attackers to limit their progress toward causing harm? This is a confounding option because learning what this attack looked like as an embryo won’t tell us what the next one will look like.

Thousands of people are like Nidal Hasan in one respect or another, but they will never commit any attack. There are thousands of people with turmoil or mental illness similar to his, for example. There are thousands of military servicemembers with doubts about U.S. policies. There are thousands of Muslims in the military (whose contributions are highly valuable). There are thousands of people who have investigated or sought contact with Al Qaeda.

If the conclusion from Fort Hood were that all people who share certain traits should be investigated/interdicted, this would violate fundamental rights and values while it wasted investigators’ time: Who is troubled enough in their minds, doubtful enough of U.S. foreign policy, etc. Whose contacts with Al Qaeda or jihadi Web sites indicate a desire to perpetrate bad acts and not curiosity or enmity?

Sending investigators into this quagmire would only work as a salve until some future rampage arose from another unique set of circumstances. We would be no safer for having investigated all who were “like” Nidal Hasan in the ways we decide are material.

Mitigation: I have seen no indication that the facilities and staff of Fort Hood were ill-equipped to deal with the results of this violence. There may be marginal ways they could improve—there always are—but medical services can’t be available everywhere always. There is little prescription for change here.

Acceptance: With the confounding difficulty of prevention and interdiction before us, this option rises a little bit in currency. Television news and commentary may make it feel differently to many people, but there is a very low probability of shootings like this happening. The costs of preventing and interdicting such violence is very high. This is a candidate for “acceptance.”

Acceptance is the least “acceptable” option, of course. Nobody thinks it is ‘ok’ for this kind of thing to happen. But like so many tragedies—indeed, part and parcel of tragedy—it is the loss of innocent life for no good reason.

Fort Hood presents the country with a choice: Invest extraordinary efforts in measures that cost a great deal, that invade prized rights, and that don’t work? Or show our sorrow to the families and community of Fort Hood and make peace with the grief and tragedy of this incident.

Obama’s (In)Decision on Afghanistan

According to CBS News, President Barack Obama will send most, if not all, of the 40,000 additional troops that General Stanley McChrystal requested and reportedly plans to keep those troops in Afghanistan for the long-term.

If the CBS report turns out to be true—the White House has backed away, and other news outlets are leaving the story alone for the moment—the president’s decision is disappointing, but expected. Last month, the administration ruled out the notion of a near-term U.S. exit from Afghanistan, arguing that the Taliban and al Qaeda would perceive an early pullout as a victory over the United States. But if avoiding a perception of weakness is the rationale that the administration is operating under then we have already lost by allowing our enemies to dictate the terms of the war.

Gen. McChrystal’s ambitious strategy hopes to integrate U.S. troops into the Afghan population. These additional troops might reduce violence in the short- to medium-term. But this strategy rests on the presumption that Afghans in heavily contested areas want the protection of foreign troops. The reality might be very different; western forces might instead be perceived as a magnet for violence.

McChrystal’s strategy also presumes that an additional 40,000 troops will be enough. But proponents of an ambitious counterinsurgency strategy need to come clean on the total bill that would be required. For a country the size of Afghanistan, with roughly 31 million people, the Army and Marine Corps counterinsurgency doctrine advises between 620,000 to 775,000 counterinsurgents—whether native or foreign. Furthermore, typical counterinsurgency missions require such concentrations of forces for a decade or more. Given these realities, we could soon hear cries of “surge,” “if only,” and “not enough.”

Even if the United States and its allies committed themselves to decades of armed nation building, success against al Qaeda would hardly be guaranteed. After all, in the unlikely event that we forged a stable Afghanistan, al Qaeda would simply reposition its presence into other regions of the world.

It is well past time for the United States to adapt means to ends. The choice for President Obama is not between counterterrorism or counterinsurgency; but between counterterrorism and counterterrorism combined with counterinsurgency. Protecting the United States from terrorism does not require U.S. troops to police Afghan villages. Where terrorists do appear, we hardly need to tinker with their communal identities. We can target our enemies with allies on the ground or, if that fails, by relying on timely intelligence for use in targeted airstrikes or small-unit raids.

President Obama’s decision on Afghanistan could define his presidency. If an escalating military strategy leads only to thousands of more deaths, and at a cost of tens or hundreds of billions of dollars, then that is a bitter legacy indeed.

Matthew Hoh: A Great American Patriot

HohFormer Marine captain Matthew Hoh became the first U.S. official known to resign in protest over the Afghan war. His letter of resignation echoes some arguments I have made earlier this year, namely, that what we are witnessing is a local and regional ethnic Pashtun population fighting against what they perceive to be a foreign occupation of their region; that our current strategy does not answer why and to what end we are pursuing  this war; and that Afghanistan holds little intrinsic strategic value to the security of the United States.

In his own words:

The Pashtun insurgency, which is composed of multiple, seemingly infinite, local groups, is fed by what is perceived by the Pashtun people as a continued and sustained assault, going back centuries, on Pashtun land, culture, traditions and religion by internal and external enemies. The U.S. and NATO presence and operations in Pashtun valleys and villages, as well as Afghan army and police units that are led and composed of non-Pashtun soldiers and police, provide an occupation force against which the insurgency is justified….I have observed that the bulk of the insurgency fights not for the white banner of the Taliban, but rather against the presence of foreign soldiers and taxes imposed by an unrepresentative government in Kabul. The United States military presence in Afghanistan greatly contributes to the legitimacy and strategy message of the Pashtun insurgency.

So, what’s the situations like now? Afghanistan’s second-round presidential elections scheduled for early November will do little to change realities on the ground. Counterinsurgency–the U.S. military’s present strategy–requires a legitimate host nation government, which we will not see for the foreseeable future regardless of who’s president.

What’s the political strategy? President Obama has painted himself into a rhetorical corner. He’s called Afghanistan the “necessary war,” even though stabilizing Afghanistan is not a precondition for keeping America safe. We must remember that al Qaeda is a global network, so in the unlikely event that America did bring security to Afghanistan, al Qaeda could reposition its presence into other regions of the world.

Should we stay or should we go? The United States must begin to narrow its objectives. If we begin to broaden the number of enemies to include indigenous insurgent groups, we could see U.S. troops fighting in perpetuity. The president has surged once into the region this year. He does not need to do so again.

This is the deadliest month so far, thoughts? Eight years after the fall of the Taliban regime, Afghanistan still struggles to survive under the most brutal circumstances: corrupt and ineffective state institutions; thousands of miles of unguarded borders; pervasive illiteracy among a largely rural and decentralized population; a weak president; and a dysfunctional international alliance. As if that weren’t enough, some of Afghanistan’s neighbors have incentives to foment instability there. An infusion of 40,000 more troops, as advocated by General Stanley McChrystal, may lead to a reduction in violence in the medium-term. But the elephant in the Pentagon is that the intractable cross-border insurgency will likely outlive the presence of international troops. Honestly, Afghanistan is not a winnable war by any stretch of the imagination.

Emanuel on TV and Filkins on McChrystal

A. It’s encouraging to see Rahm Emanuel and John Kerry saying that we shouldn’t up force levels in Afghanistan without a reliable partner. But if we shouldn’t send 40,000 more troops to prop up a crooked government, why keep the 68,000 we have there? A focused counter-terrorism mission would require far less than that.

B. According to Dexter Filkins’ article in the New York Times Magazine, the war in Iraq taught General Stanley McChrystal the following:

No situation, no matter how dire, is ever irredeemable — if you have the time, resources and the correct strategy. In the spring of 2006, Iraq seemed lost. The dead were piling up. The society was disintegrating. One possible conclusion was that it was time for the United States to cut its losses in a country that it never truly understood. But the American military believed it had found a strategy that worked, and it hung in there, and it finally turned the tide.

What’s interesting about this claim is its utter confidence in the potential efficacy of US military power — it is not just necessary to solving Iraq’s problems, but sufficient. If this view is right, Iraqis themselves, and their civil war, were unnecessary to the limited political reconciliation that occurred there.

Filkins, surprisingly, seems to agree, depicting the evolution of the war this way:

For four years, the American military had tried to crush the Iraqi insurgency and got the opposite: the insurgency bloomed, and the country imploded. By refocusing their efforts on protecting Iraqi civilians, American troops were able to cut off the insurgents from their base of support. Then the Americans struck peace deals with tens of thousands of former fighters — the phenomenon known as the Sunni Awakening — while at the same time fashioning a formidable Iraqi army. After a bloody first push, violence in Iraq dropped to its lowest levels since the war began.

Note the use of the word “then” preceding the sentence about peace deals. It carries a heavy load. Filkins wants to say that the hearts and mind theory of counterinsurgency caused the Anbar Awakening. But he offers no real causal story about how they are connected; he just says that one happened and then the other.

Another view, one that leaves Iraqis some agency, is that the growth of the al Qaeda Iraq and the progress of the civil war changed the Sunni insurgents’ strategic calculus, such that they decided to cooperate with Americans to gain locally. And that in turn, limited violence. U.S. forces had a role in this — the covert killing campaign that McChrystal led and Filkins chronicles probably pressured insurgents and weakened AQI, for one. But the deals — the awakening — began well before the troop surge and before David Petraeus took command and tried to implement a new counterinsurgency doctrine. The key American decision was willingness to play ball with insurgent groups. This decision had little to do with winning hearts and minds via population security and increased troop levels. And by empowering forces at odds with the central government, it contradicted the goal of state-building in Iraq, at least in the short-term.

I obviously agree with the latter view. Our dependence on local politics limits what we can accomplish in counterinsurgency. We can certainly affect what happens in Afghanistan, but it is hubris to think we control it.

Filkins also quotes McChrystal on Afghanistan’s effect on Pakistan:

“If we are good here, it will have a good effect on Pakistan,” he told me. “But if we fail here, Pakistan will not be able to solve their problems — it would be like burning leaves on a windy day next door.

It’s sensible to conclude chaos nearby is unhelpful to stability in Pakistan, but it goes way too far to say that Afghanistan’s stability is necessary to Pakistan’s, which has been fairly stable for long periods while Afghanistan was not. What’s more, as Robert Pape argues, it is likely that U.S. forces are a cause of insurgency in both countries.

PATRIOT Powers: Roving Wiretaps

Last week, I wrote a piece for Reason in which I took a close look at the USA PATRIOT Act’s “lone wolf” provision—set to expire at the end of the year, though almost certain to be renewed—and argued that it should be allowed to lapse. Originally, I’d planned to survey the whole array of authorities that are either sunsetting or candidates for reform, but ultimately decided it made more sense to give a thorough treatment to one than trying to squeeze an inevitably shallow gloss on four or five complex areas of law into the same space. But the Internets are infinite, so I’ve decided I’d turn the Reason piece into Part I of a continuing series on PATRIOT powers.  In this edition: Section 206, roving wiretap authority.

The idea behind a roving wiretap should be familiar if you’ve ever watched The Wire, where dealers used disposable “burner” cell phones to evade police eavesdropping. A roving wiretap is used when a target is thought to be employing such measures to frustrate investigators, and allows the eavesdropper to quickly begin listening on whatever new phone line or Internet account his quarry may be using, without having to go back to a judge for a new warrant every time. Such authority has long existed for criminal investigations—that’s “Title III” wiretaps if you want to sound clever at cocktail parties—and pretty much everyone, including the staunchest civil liberties advocates, seems to agree that it also ought to be available for terror investigations under the Foreign Intelligence Surveillance Act. So what’s the problem here?

For Obama, Peace in the Morning, War in the Afternoon

Hours after thanking the world for the Nobel Peace Prize this morning, President Obama will gather with his war advisers to ponder sending 60,000 more troops into a country where our national security objectives are unclear at best.

Instead of embracing General McChrystal’s proposal for a substantial increase in the U.S. military presence — or even adopting a “McChrystal-Light” strategy — the Obama administration should begin a phased withdrawal of troops over the next 18 months, retaining only a small military footprint relying on special forces personnel. Otherwise, America will be entangled for years — or decades — in pursuit of unattainable goals.

We need to “define success down” in Afghanistan. That means abandoning any notion of transforming ethnically fractured, pre-industrial Afghanistan into a modern, cohesive nation state. It also means reversing the drift in Washington’s strategy over the past eight years that has gradually made the Taliban (a parochial Pashtun insurgent movement), rather than al Qaeda, America’s primary enemy in Afghanistan. A more modest and realistic strategy means even abandoning the goal of a definitive victory over al Qaeda itself.

Instead, we need to treat the terrorist threat that al Qaeda poses as a chronic, but manageable, security problem. Foreign policy, like domestic politics, is the art of the possible. Containing and weakening al Qaeda may be possible, but sustaining a large-scale, long-term occupation of Afghanistan and creating a modern, democratic country is not.

Exiting the Afghan Quagmire

Maleeha Lodhi, Pakistan’s former ambassador to Washington, and Anatol Lieven, a professor at King’s College London, discuss in the Financial Times how we can exit the Afghan quagmire:

The west should therefore pursue a political solution, open negotiations with the Taliban and offer a timetable for a phased withdrawal in return for a ceasefire. This should begin with the military pulling out of specific areas in return for Taliban guarantees not to attack western bases and Afghan authorities in those areas. If the Taliban refuses such terms, then military pressure should continue. The point should not be to eliminate the Taliban – which is impossible – but to persuade it to agree to a deal.

Lodhi and Lieven’s argument echoes one that David Axe, Jason Reich, and I made yesterday on ForeignPolicy.com.

… regime change, and democracy, are not necessary for counterterrorism. Propping up President Hamid Karzai’s Western-style government in Kabul does not make operations against al Qaeda any easier or more successful. If anything, it distracts from the conceptually simpler task of finding and killing terrorists. Without U.S. and NATO protection, Karzai’s regime would, sooner or later, probably fall to the Taliban. But U.S. observers should not equate that eventuality with “losing” the war. The war is against terrorists, not Islamist governments. The United States should be prepared to make peace, and amends, with a resurgent Taliban — and to encourage the group to excise its more extreme elements.

I admit talking to the Taliban sounds weird and scary. But my contention is that there is no shortage of Pashtun militants willing to fight against what they perceive to be a foreign occupation of their region. Certainly the Taliban does not enjoy support among the majority of Pashtuns—as Lodhi and Lieven point out—but neither did the IRA in Northern Ireland or the FLN in Algeria. The point is not exclusively about popularity (although that’s a critical component, along with local legitimacy), but the fact that these indigenous groups are willing to fight the United States and NATO indefinitely. Indeed, it is the western military presence that is driving support for the Taliban both in Afghanistan and in Pakistan.

Moreover, the notion that we must protect Pakistan from the Taliban is ludicrous. Pakistan’s intelligence service helped create the Taliban and they continue to protect the Afghan Taliban to keep India at bay. From this point of view, deploying more troops would be irrelevant to the fight against al Qaeda and counterproductive in our attempts to pacify the region. NYT Columnist, Meet NYT Reporter

In the New York Times this weekend, columnist Thomas Friedman wrote, “[W]e may be tired of this ‘war on terrorism,’ but the bad guys are not. They are getting even more ‘creative.’”

On September 26th, the New York Times reported in a story by Scott Shane:

Many students of terrorism believe that in important ways, Al Qaeda and its ideology of global jihad are in a pronounced decline — with its central leadership thrown off balance as operatives are increasingly picked off by missiles and manhunts and, more important, with its tactics discredited in public opinion across the Muslim world.

Who’s right? Should we be more concerned or less?

Well, the statements are not inconsistent. But unlike the analysts cited in the news story, columnist Friedman uses loaded terms and broad generalizations like “war on terror”, “bad guys”, and “creative” to misconstrue the nature of the terrorist threat.

Friedman says “war” a dizzying seventeen times in his short column, misdescribing the many different efforts that go into suppressing terrorism, dissuading terrorist recruits, and capturing or killing terrorists.

He lumps all terrorists together as “bad guys” despite expert counsel against assuming they have similar aims and motives, or that they collaborate.

And “creative”?—well, putting a bomb in your keister is creative, but it is not an effective way to harm anyone other than yourself.

But don’t jump to the wrong conclusion. The point is not to dismiss terrorism as a threat. It’s to know that terrorists are fallible, al Qaeda is on the wane, and law enforcement is on the case. In terrorism, we are not confronted by anything close to an existential threat.

Friedman’s column is a reach, and it does a distinctly bad job of working with any of these subtleties. (The only reason I feel compelled to call them “subtleties,” I suppose, is because they seem to remain beyond the grasp of an otherwise intelligent and thoughtful New York Times columnist.)

Is the U.S. Government Behaving Strategically With Regard to Al Qaeda?

To its credit, the Department of Homeland Security distributes important documents via email. (Subscribe on their home page by scrolling down to find the “Subscribe to E-mail Updates:” box in the right column, then select your preferences.)

Yesterday DHS sent me a copy of the written testimony by Michael E. Leiter, Director of the National Counterterrorism Center, for a Senate Homeland Security and Governmental Affairs Committee hearing titled: “Eight Years After 9/11: Confronting the Terrorist Threat to the Homeland.”

As I read Leiter’s (relatively brief) testimony, I wondered how well it squares with the strategic counsel offered by Audrey Kurth Cronin, Professor of Strategy at the U.S. National War College, Senior Research Associate in the Changing Character of War Programme at Oxford University, and a participant in Cato’s January counterterrorism strategy conference.

In her Institute for International Strategic Studies paper, “Ending Terrorism: Lessons for Defeating Al-Qaeda,” she offered several counterterrorism strategy pointers:

The first prong of a successful strategy to counter al-Qaeda’s terrorism is to clarify to audiences around the globe exactly what al-Qaeda is and what it is not. This is not just of academic interest. It is partly because there is so much vague use of the name ‘al-Qaeda’ that it seems superhuman and ubiquitious. . . . When politicians and experts employ the term ‘al-Qaeda’ loosely, they help its propagandists to construct and perpetuate their desired image and to mobilise support.

. . .

Violent internal cleavages and bickering are endemic to the al-Qaeda movement, and have been from the outset, and the second prong in a successful strategy against al-Qaeda is consciously to exploit them.

. . .
The third element in a successful strategy against al-Qaeda is to disaggregate the many elements of the movement and develop more sophisticated, targeted counter-terrorism policies tailored to its constituent parts. The aim must be to enlarge the movement’s internal inconsistencies and differences . . . .

At our counterterrorism conference, terrorism expert Marc Sageman similarly said, “We often unify our enemies needlessly. . . . Let’s not unify our enemy and give it strength that way.”  (If you don’t watch all of panel III, you can start at minute 66.)

More Fear-Mongering Claptrap from Max Boot

Max Boot, fellow for National Security Studies at the Council on Foreign Relations and perhaps one of America’s most radical neo-imperialists, eight years ago this month likened the Afghan mission to British colonial rule:

Afghanistan and other troubled lands today cry out for the sort of enlightened foreign administration once provided by self-confident Englishmen in jodhpurs and pith helmets…This was supposed to be ‘for the good of the natives,’ a phrase that once made progressives snort in derision, but may be taken more seriously after the left’s conversion (or, rather, reversion) in the 1990s to the cause of ‘humanitarian’ interventions. [emphasis mine]

Just yesterday, this “stay-the-course” proponent said President Obama should fight on in Afghanistan and properly resource the counterinsurgency mission. Sadly, Boot’s arguments are so faulty and disjointed that it is difficult to decide where to begin first. Here I go…

Boot believes that the coalition should properly resource the war effort. What does that even mean? What Boot neglects to tell his readers is that our current policy requires more troops than we could ever send. The metric for successful counterinsurgency missions suggested by the U.S. Army and Marine Corps would require 200,000 counterinsurgents in southern Afghanistan alone, and upwards of 650,000 in the country as a whole, for upwards of 12 to 14 years—not including the last eight. The time and resources required for assisting Afghanistan would not be accomplished within costs acceptable to American and NATO publics.

Another critical point that Boot fails to disclose is how recklessly ambitious the current mission is. The cost in blood and treasure that we would have to incur—coming on top of what we have already paid—far outweighs any possible benefits, even accepting the most optimistic estimates for the likelihood of success. The United States does not have the patience, cultural knowledge, or legitimacy to transform what is a deeply divided, poverty stricken, tribal-based society into a self-sufficient, non-corrupt, and stable electoral democracy. And even if Americans did commit several hundred thousand troops and decades of armed nation-building, success would hardly be guaranteed, especially in a country notoriously suspicious of outsiders and largely devoid of central authority. Western powers could invest hundreds of thousands of troops and twice or three times the materiel and money and still not create a functioning state. Even in the unlikely event that we forged a stable Afghanistan, al Qaeda might simply reposition its presence into other regions of the world.

McChrystal’s Assessment

General-Stanley-McChrysta-001In his review of the war in Afghanistan,  states that “failure to gain the initiative and reverse insurgent momentum in the near-term (next 12 months)—while Afghan security capacity matures—risks an outcome where defeating the insurgency is no longer possible.”

I would hope that Congress and the American people hold McChrystal to his “12 month” prediction, because if President Obama sticks to McChrystal’s ambitious strategy, U.S. forces could remain in Central Asia for decades.

McChrystal argues that the U.S. military must devote more effort to interacting with the local population and elevating the importance of governance. How? Does America defeat the Taliban in order to build an Afghan state, or does America build an Afghan state in order to defeat the Taliban? Winning the support of the population through a substantial investment in civilian reconstruction cannot take place without some semblance of stability on the ground. The mission’s multi-disciplinary approach (“an integrated civilian-military counterinsurgency campaign”) is understandable, but oftentimes its feasibility is simply assumed.

Unfortunately, the United States has drifted into an amorphous nation building mission with unlimited scope and unlimited duration. Our objective must be narrowed to disrupting al Qaeda. To accomplish that goal, America does not need to transform Afghanistan into a stable, modern, democratic society with a strong central government in Kabul—or forcibly democratize the country, as our current mission would have us do, or as McChrystal states “Elevat[ing] the importance of governance.” These goals cannot be achieved at a reasonable cost in blood and treasure in a reasonable amount of time—let alone the next 12 months.

Pakistan: More Aid, More Waste, More Fraud?

Pakistan long has tottered on the edge of being a failed state:  created amidst a bloody partition from India, suffered under ineffective democratic rule and disastrous military rule, destabilized through military suppression of East Pakistan (now Bangladesh) by dominant West Pakistan, dismembered in a losing war with India, misgoverned by a corrupt and wastrel government, linked to the most extremist Afghan factions during the Soviet occupation, allied with the later Taliban regime, and now destabilized by the war in Afghanistan.  Along the way the regime built nuclear weapons, turned a blind eye to A.Q. Khan’s proliferation market, suppressed democracy, tolerated religious persecution, elected Asif Ali “Mr. Ten Percent” Zardari as president, and wasted billions of dollars in foreign (and especially American) aid.

Still the aid continues to flow.  But even the Obama administration has some concerns about ensuring that history does not repeat itself.  Reports the New York Times:

As the United States prepares to triple its aid package to Pakistan — to a proposed $1.5 billion over the next year — Obama administration officials are debating how much of the assistance should go directly to a government that has been widely accused of corruption, American and Pakistani officials say. A procession of Obama administration economic experts have visited Islamabad, the capital, in recent weeks to try to ensure both that the money will not be wasted by the government and that it will be more effective in winning the good will of a public increasingly hostile to the United States, according to officials involved with the project.

…The overhaul of American assistance, led by the State Department, comes amid increased urgency about an economic crisis that is intensifying social unrest in Pakistan, and about the willingness of the government there to sustain its fight against a raging insurgency in the northwest. It follows an assessment within the Obama administration that the amount of nonmilitary aid to the country in the past few years was inadequate and favored American contractors rather than Pakistani recipients, according to several of the American officials involved.

Rather than pouring more good money after bad, the U.S. should lift tariff barriers on Pakistani goods.  What the Pakistani people need is not more misnamed “foreign aid” funneled through corrupt and inefficient bureaucracies, but jobs.  Trade, not aid, will help create real, productive work, rather than political patronage positions.

Bagram, Habeas, and the Rule of Law

Andrew C. McCarthy has an article up  at National Review criticizing a recent decision by Obama administration officials to improve the detention procedures in Bagram, Afghanistan.

McCarthy calls the decision an example of pandering to a “despotic” judiciary that is imposing its will on a war that should be run by the political branches. McCarthy’s essay is factually misleading, ignores the history of wartime detention in counterterrorism and counterinsurgency, and encourages the President to ignore national security decisions coming out of the federal courts.

Columbia University IR guru Robert Jervis has a smart post at Foreign Policy’s “Af-Pak” blog.  For those who couldn’t get enough at yesterday’s Cato forum on Afghanistan, Jervis’ post is well worth a look:

Most discussion about Afghanistan has concentrated on whether and how we can defeat the Taliban. Less attention has been paid to the probable consequences of a withdrawal without winning, an option toward which I incline. What is most striking is not that what I take to be the majority view is wrong, but that it has not been adequately defended. This is especially important because the U.S. has embarked on a war that will require great effort with prospects that are uncertain at best. Furthermore, it appears that Obama’s commitment to Afghanistan was less the product of careful analysis than of the political need to find a “tough” pair to his attacks on the war in Iraq during the presidential campaign. It similarly appears that in the months since his election he has devoted much more attention to how to wage the war than to whether we need to wage it.

Afghanistan = Bottomless Pit of Massive Social Engineering

Obsidian Wings echoes my frustrations about the debate surrounding the war in Afghanistan. Publius notes, “The goal of preventing Taliban control isn’t a sufficient reason to stay.”

That analysis is absolutely right. As I mention in my forthcoming white paper (co-authored with TGC), Escaping the Graveyard of Empires: A Strategy to Exit Afghanistan, the resurrection of the Taliban’s fundamentalist regime doesn’t threaten America’s sovereignty or physical security. The Taliban is a guerilla-jihadi Pashtun-dominated movement with no international agenda or shadowy global mission. Even if their parochial fighters took over a contiguous fraction of Afghan territory it is not compelling enough of a rationale to maintain an indefinite, large-scale military presence in the region, especially since our presence feeds the Pashtun insurgency we seek to defeat (as Publius also acknowledges) and our policies are pushing the conflict over the border into nuclear-armed Pakistan, further destabilizing its already shaky government.

Even if the Taliban were to reassert themselves amid a scaled down U.S. presence, it is not clear that the Taliban would again host al Qaeda. In The Looming Tower: Al-Qaeda and the Road to 9/11, Lawrence Wright, staff writer for New Yorker magazine, found that before 9/11 the Taliban was divided over whether to shelter Osama bin Laden. The terrorist financier wanted to attack Saudi Arabia’s royal family, which, according to Wright, would have defied a pledge Taliban leader Mullah Omar made to Prince Turki al-Faisal, chief of Saudi intelligence (1977–2001), to keep bin Laden under control. The Taliban’s reluctance to host al Qaeda’s leader means it is not a foregone conclusion that the same group would provide shelter to the same organization whose protection led to their overthrow.

Moreover, America’s claim that the Taliban is its enemy seems less than coherent. After all, although some U.S. officials issued toothless and perfunctory condemnations of the Taliban when it controlled most of Afghanistan from September 1996 through October 2001, during that time the United States never once made a substantive policy shift toward or against the Taliban despite knowing that it imposed a misogynistic, oppressive, and militant Islamic regime onto Afghans. For Washington to now pursue an uncompromising hostility toward the Taliban’s eye-for-an-eye brand of justice can be interpreted as an opportunistic attempt to cloak U.S. strategic ambitions in moralistic values.

On a side note, another conservative joins George Will for getting out of Afghanistan.

Tell Me How This Ends

Yesterday, President Obama defended his new approach to the war in Afghanistan. According to the president, our strategy is to disrupt, dismantle, and defeat al Qaeda and its extremist allies. In order to accomplish this goal, Obama’s strategy indicates we must create a functioning national state there.

Why?

Beltway orthodoxy tells us it’s because extremists will emerge in ungoverned parts of the world and attack the United States. As my colleagues Justin Logan and Chris Preble point out here, there’s reason to doubt whether state failure or poor governance in itself poses a threat.

But responsible leaders would be upfront about the expected costs of our policy: to transform what is a deeply divided, poverty stricken, tribal-based society into a self-sufficient, non-corrupt, stable democracy would require a multi-decade commitment—and even then there’d be no assurance of success.

Why Afghanistan’s form of governance directly implicates America’s security, or why it demands the deployment of tens of thousands of U.S. troops to police it are questions rarely asked let alone addressed.

Pakistani Taliban Commander Dead

While American officials have yet to confirm his death, Baitullah Mehsud, the leader of Tehrik-e-Taliban Pakistan (TTP), which operates as Pakistan’s version of the Taliban, may have been killed Wednesday in an American missile attack in South Waziristan. Pakistan viewed Mehsud as its top internal threat. He was blamed for a wave of attacks that killed nearly 2,000 people in the past two years. He was also suspected of killing former prime minister Benazir Bhutto, and of having connections to al Qaeda.

Three things:

Number one, Mehsud’s death may or may not be a big blow to the TTP. Other deputies can easily take his place. In fact, shortly after Mehsud’s purported death, the Taliban Shura (an advisory council meeting) convened to elect a new TTP chief. (Among those being considered are Hakimullah Mehsud, Azmatullah Mehsud and Waliur Rehman Mehsud. The successor might be announced after Friday evening prayers). Any of these new leaders could quickly pick up where Baitullah left off, which means that picking off high-value targets in any insurgency does not guarantee that jihadists will melt away. We could only hope that a leadership void creates a power struggle among rival factions of the group, but that seems unlikely.

Number two, the drone operation shows improved coordination between the United States and Pakistan, which is welcome news. But the strike exemplifies the binary nature of the discussion surrounding the use of aerial drones: On the one hand, U.S. officials point to the successful killing of high-level al-Qaeda militants, such as Abu Laith al-Libi in January 2008, and chemical weapons expert Abu Khabab al Masri in July 2008. On the other hand, drone strikes have triggered collective armed action throughout the tribal agencies and have added more fuel to violent religious radicalism in this unstable, nuclear-armed country. One U.S. military official, who spoke on the condition of anonymity to McClatchy Newspaper correspondent Jonathan Landay, called drone operations “a recruiting windfall for the Pakistani Taliban.”

Number three, Pakistan might continue the same policy as before, differentiating between the “good Taliban” (those who attack U.S. and NATO forces in Afghanistan) and “bad Taliban” (those who attack the Pakistani military and the government). At the strategic level, Pakistan and the United States are still not on the same page.

Fixing Detention

The Obama administration performed another Friday afternoon Guantanamo news dump last week, indicating that it will probably maintain administrative military detention of combatants under a forthcoming executive order.

This is unnecessary executive unilateralism. As Benjamin Wittes and Jack Goldsmith point out in today’s Washington Post, this is a debate that ought to be held in Congress.

This would not be a tough push for Obama. The Obama administration already amended its claim of authority in a filing with the District Court for the District of Columbia, the judicial body sorting through the detainees remaining at Gitmo. Convincing Congress to ratify this decision should not be hard; the differences between the Bush administration’s “enemy combatant” criteria and what the Obama administration defines as “substantially supporting” Al Qaeda and the Taliban are minute. As I wrote in a previous post on detention definitions and decisions, the actions proscribed under these two standards and the activities constituting the “direct participation in hostilities” standard used in the case of Salim Hamdan are nearly identical.

The only positive news about the pending announcement is that the creation of a national security court specializing in detention decisions is probably not in the cards. As I have said before, national security court proposals play the propaganda game the way terrorists want to and often revive the prospect of domestic preventive detention of terror suspects, to include American citizens who would otherwise be charged with a substantive crime for domestic acts. The Cato Institute filed an amicus brief opposing this practice in the Padilla case.

Week in Review: A Speech in Cairo, an Anniversary in China and a U.S. Bankruptcy

Obama Speaks to the Muslim World

cairoIn Cairo on Thursday, President Obama asked for a “new beginning between the United States and Muslims around the world,” and spoke at some length on the Israeli-Palestinian conflict, Iran, Iraq, and Afghanistan. Cato scholar Christopher Preble comments, “At times, it sounded like a state of the union address, with a litany of promises intended to appeal to particular interest groups. …That said, I thought the president hit the essential points without overpromising.”

Preble goes on to say:

He did not ignore that which divides the United States from the world at large, and many Muslims in particular, nor was he afraid to address squarely the lies and distortions — including the implication that 9/11 never happened, or was not the product of al Qaeda — that have made the situation worse than it should be. He stressed the common interests that should draw people to support U.S. policies rather than oppose them: these include our opposition to the use of violence against innocents; our support for democracy and self-government; and our hostility toward racial, ethnic or religious intolerance. All good.

David Boaz contends that there are a number of other nations the president could have chosen to deliver his address:

Americans forget that the Muslim world and the Arab world are not synonymous. In fact, only 15 to 20 percent of Muslims live in Arab countries, barely more than the number in Indonesia alone and far fewer than the number in the Indian subcontinent. It seems to me that Obama would be better off delivering his message to the Muslim world somewhere closer to where most Muslims live. Perhaps even in his own childhood home of Indonesia.

Not only are there more Muslims in Asia than in the Middle East, the Muslim countries of south and southeast Asia have done a better job of integrating Islam and modern democratic capitalism…. Egypt is a fine place for a speech on the Arab-Israeli conflict. But in Indonesia, Malaysia, India, or Pakistan he could give a speech on America and the Muslim world surrounded by rival political leaders in a democratic country and by internationally recognized business leaders. It would be good for the president to draw attention to this more moderate version of Islam.

Tiananmen Square: 20 Years Later

tsquare1It has been 20 years since the tragic deaths of pro-democracy protesters in Tiananmen Square in June 1989, and 30 years since Deng Xiaoping embarked on economic reform in China. Cato scholar James A. Dorn comments, “After 20 years China has made substantial economic progress, but the ghosts of Tiananmen are restless and will continue to be so until the Goddess of Liberty is restored.”

In Thursday’s Cato Daily Podcast, Dorn discusses the perception of human rights in China since the Tiananmen Square massacre, saying that many young people are beginning to accept the existence of human rights independent of the state.

A few days before the anniversary, social media Web sites like Twitter and YouTube were blocked in China. Cato scholar Jim Harper says that it’s going to take a lot more than tanks to shut down the message of freedom in today’s online world:

In 1989, when a nascent pro-democracy movement wanted to communicate its vitality and prepare to take on the state, meeting en masse was vital. But that made it fairly easy for the CCP to roll in and crush the dream of democracy.

Twenty years later, the Internet is the place where mass movements for liberty can take root. While the CCP is attempting to use the electronic equivalent of an armored division to prevent change, reform today is a question of when, not if. Shutting down open dialogue will only slow the democratic transition to freedom, which the Chinese government cannot ultimately prevent.

Taxpayers Acquire Failing Auto Company

After billions of dollars were spent over the course of two presidential administrations to keep General Motors afloat, the American car company filed for bankruptcy this week anyway.

Last year Cato trade expert Daniel J. Ikenson appeared on dozens of radio and television programs and wrote op-eds in newspapers and magazines explaining why automakers should file for bankruptcy—before spending billions in taxpayer dollars.

Which leaves Ikenson asking one very important question: “What was the point of that?

In November, GM turned to the federal government for a bailout loan — the one final alternative to bankruptcy. After a lot of discussion and some rich debate, Congress voted against a bailout, seemingly foreclosing all options except bankruptcy. But before GM could avail itself of bankruptcy protection, President Bush took the fateful decision of circumventing Congress and diverting $15.4 billion from Troubled Asset Relief Program funds to GM (in the chummy spirit of avoiding tough news around the holidays).

That was the original sin. George W. Bush is very much complicit in the nationalization of GM and the cascade of similar interventions that may follow. Had Bush not funded GM in December (under questionable authority, no less), the company probably would have filed for bankruptcy on Jan. 1, at which point prospective buyers, both foreign and domestic, would have surfaced and made bids for spin-off assets or equity stakes in the “New GM,” just as is happening now.

Meanwhile, the government takeover of GM puts the fate of Ford Motors, a company that didn’t take any bailout money, into question:

Thus, what’s going to happen to Ford? With the public aware that the administration will go to bat for GM, who will want to own Ford stock? Who will lend Ford money (particularly in light of the way GM’s and Chrysler’s bondholders were treated). Who wants to compete against an entity backed by an unrestrained national treasury?

Ultimately, if I’m a member of Ford management or a large shareholder, I’m thinking that my biggest competitors, who’ve made terrible business decisions over the years, just got their debts erased and their downsides covered. Thus, even if my balance sheet is healthy enough to go it alone, why bother? And that calculation presents the specter of another taxpayer bailout to the tunes of tens of billions of dollars, and another government-run auto company.

Some Early Thoughts on Obama’s Speech

I listened live to the president’s Cairo speech this morning on my ride into work. I know that it will be parsed and dissected. Passages will be taken out of context, and sentences twisted beyond recognition. At times, it sounded like a state of the union address, with a litany of promises intended to appeal to particular interest groups.

That said, I thought the president hit the essential points without overpromising. He did not ignore that which divides the United States from the world at large, and many Muslims in particular, nor was he afraid to address squarely the lies and distortions — including the implication that 9/11 never happened, or was not the product of al Qaeda — that have made the situation worse than it should be. He stressed the common interests that should draw people to support U.S. policies rather than oppose them: these include our opposition to the use of violence against innocents; our support for democracy and self-government; and our hostility toward racial, ethnic or religious intolerance. All good.

Two particular comments jumped out at me (the speech text can be found here):

1. The president clearly stated his goals for the U.S. military presence in Iraq. He pledged to “honor our agreement with Iraq’s democratically-elected government to remove combat troops from Iraqi cities by July,” “the removal of our combat brigades by next August,” and “to remove all our troops from Iraq by 2012.”

This might not seem like much. As noted, it is the established policy of the U.S. government and the Iraqi government under the status of forces agreement. Some recent comments by Army Chief of Staff Gen. George Casey, however, implied that U.S. troops might remain in Iraq for a decade. I’m glad that the president cleared up the confusion.

2. President Obama wisely connected U.S. policy in the 21st century to its founding principles from the earliest days to remind his audience — or perhaps to teach them for the very first time — that the United States was not now, nor ever has been, at war with Islam, or with any other religion. George Washington affirmed the importance of religious equality in his letter to the Hebrew Congregation in Newport, Rhode Island. President Obama quoted John Adams, who saw no reason why the United States could not enjoy good relations with Morocco, the first country to recognize the United States. When signing the Treaty of Tripoli, Adams wrote, “The United States has in itself no character of enmity against the laws, religion or tranquility of Muslims.”

But the president also drew on the Founders to convey a broader message. They believed that the new nation should advance human rights and the cause of liberty by its example, not by military force. Some of our recent leaders seem to have forgotten that, and a few pundits have actually scorned the suggestion. The president wisely cast his lot with the earlier generation, quoting Thomas Jefferson who said “I hope that our wisdom will grow with our power, and teach us that the less we use our power the greater it will be.”

It is a good quote. I use it in my book, too.
