			<content:encoded><![CDATA[<p>By David Rittgers</p><p>Several people videotaped the arrest of a belligerent woman at the Preakness Stakes and posted it online. The woman assaulted another patron of the race and two officers during her well-deserved arrest.</p>
<p>The criminalization of citizens’ recordings of the arrest, which culminates in the woman lying face down and bleeding, is a different matter.</p>
<p>Toward the end of the video, <a href="http://www.youtube.com/watch?v=nWF3Ddr7vdc&amp;feature=related">posted on YouTube</a> (warning: violence and language), a police officer approaches the person filming the arrest and says, &#8220;Do me a favor and turn that off. It&#8217;s illegal to videotape anybody&#8217;s voice or anything else, against the law in the state of Maryland.&#8221;</p>
<p>Unfortunately, the officer was right.</p>
<p>The Maryland wiretapping law <a href="http://law.justia.com/maryland/codes/gcj/10-402.html">makes it illegal</a> to record a conversation without the consent of all parties involved. The Preakness incident <a href="http://wjz.com/local/preakness.fight.internet.2.1708562.html">sparked a debate</a> about the wisdom of a law that makes it illegal to provide public accountability of police actions.</p>
<p>This is the latest in a <a href="http://weblogs.baltimoresun.com/news/crime/blog/2010/05/recording_in_public.html">rash of incidents</a> where Maryland police were recorded while using force or making arrests. While the Maryland law makes an exception for police to record their encounters with citizens, Maryland law enforcement officers will arrest and indict anyone who records their encounter with the police.</p>
<p><a href="../../../../../2010/04/14/felony-charges-for-recording-a-plainclothes-officer/">Case in point</a>: Anthony Graber was riding his motorcycle and recording the experience with a helmet-mounted camera. He was riding recklessly and beyond the speed limit, which warranted a citation, but not his detention by a Maryland State Police officer at gunpoint and the trooper not first identifying himself as an officer of the law. The first few seconds of the encounter look like a carjacking, not enforcement of traffic laws. Graber posted his interaction with law enforcement officers on YouTube and was arrested for it. He now faces felony charges under the wiretapping statute, and prosecutors sought $15,000 bond for a crime that carries a maximum $10,000 fine. The judge <a href="http://open.salon.com/blog/gordon_wagner/2010/04/17/motorcyclist_jailed_for_26_hours_for_videotaping_psycho_cop">reportedly questioned</a> the charges at the bond hearing. Graber goes to trial on June 1st.</p>
<p>This is a questionable policy in the same state where <a href="../../../../../2010/04/13/university-of-maryland-beating-prompts-investigations/">excessive use of force against a University of Maryland student</a> resulted in discipline and possible criminal charges for three Prince George’s County officers. The same jurisdiction knew that Berwyn Heights Mayor Cheye Calvo may have had nothing to do with a drug trafficking ring, but <a href="../../../../../2009/09/18/cheye-calvo-reflects-on-swat-shooting/">raided his home at gunpoint anyway</a>, terrorized his family, and shot his dogs. The result of the raid was that there was <a href="../../../../../2009/06/22/no-wrongdoing-in-the-calvo-raid/">no wrongdoing</a> by Calvo and his family.</p>
<p>The Maryland wiretapping law is itching for an update. It’s time for the Maryland code to stop acting as a barrier to transparency in law enforcement operations.</p>

			<content:encoded><![CDATA[<p>By Tim Lynch</p><p>Cheye Calvo is the DC-area small-town mayor who had his two pet dogs shot and killed by a botched drug raid about a year ago.  In an <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/09/17/AR2009091701680.html">article</a> to be published in this Sunday&#8217;s <em>Washington Post</em>, Calvo reflects upon his experience &#8212; not just the raid itself, but on the actions of the police department afterward.  Excerpt:</p>
<blockquote><p>I remain captured by the broader implications of the incident. Namely, that my initial take was wrong: It was no accident but rather business as usual that brought the police to &#8212; and through &#8212; our front door.</p>
<p>In the words of Prince George&#8217;s County Sheriff Michael Jackson, whose deputies carried out the assault, &#8220;the guys did what they were supposed to do&#8221; &#8212; acknowledging, almost as an afterthought, that terrorizing innocent citizens in Prince George&#8217;s [County] is standard fare. The only difference this time seems to be that the victim was a clean-cut white mayor with community support, resources, and a story to tell the media.</p>
<p>What confounds me is the unmitigated refusal of county leaders to challenge law enforcement and to demand better &#8212; as if civil rights are somehow rendered secondary by the war on drugs.</p></blockquote>
<p>Mr. Calvo has been a super advocate for reform &#8212; he has given up countless hours of his spare time to study and speak on this subject so that fewer people will be victimized the same way his family was.  He spoke at a <a href="http://www.cato.org/event.php?eventid=6207">Cato Hill Briefing</a> over the summer.</p>

			<content:encoded><![CDATA[<p>By David Rittgers</p><p>Last year the Prince George&#8217;s County Sheriff&#8217;s Department SWAT Team <a href="http://www.cato-at-liberty.org/2009/02/02/more-on-the-calvo-raid/">raided</a> the home of Berwyn Heights, Maryland Mayor Cheye Calvo. Police officers on the case knew that dealers were sending packages to random addresses so that accomplices in delivery companies could pick them up. The officers didn&#8217;t take the drugs out of circulation at the warehouse when they intercepted them. They simply sent them to the bogus address and raided it. The investigating officers did this without checking with local law enforcement officials, who probably would have told them that the mayor wasn&#8217;t a drug dealer and that they were barking up the wrong tree. The SWAT team shot and killed Mayor Calvo&#8217;s two dogs and caused significant property damage to his home before they got around to figuring out his (nonexistent) role in narcotics trafficking.</p>
<p>The Sheriff&#8217;s Office just <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/06/19/AR2009061903175.html">cleared</a> its deputies of any wrongdoing.</p>
<p><a href="http://www.reason.com/staff/hitandrun/143.html">Radley Balko</a> has a <a href="http://www.reason.com/blog/show/134254.html">post</a> up at Reason. 			<content:encoded><![CDATA[<p>By David Rittgers</p><p>Mayor Daley of Chicago is planning to put <a href="http://www.suntimes.com/news/politics/1440402,mayor-daley-emergency-surveillance-cameras.article">a surveillance camera on every corner</a> to aid first responders and deter terrorism.  As I&#8217;ve <a href="../../../../../2008/12/18/inside-the-dept-of-homeland-security/">said before</a>, cameras don&#8217;t deter terrorism, but they do satisfy the need to &#8220;do something&#8221; without really improving security.  Police officers prevent attacks with traditional investigation and intelligence gathering; cameras are only useful in picking up the pieces after the attack is done.  My colleague Jim Harper is cited in <a href="http://abcnews.go.com/US/Story?id=3360287&amp;page=1">this piece</a> that addresses their utility in more detail.  Cameras didn&#8217;t stop the 7/7 bombings in London, but they took lots of <a href="http://www.guardian.co.uk/uk/2008/aug/01/july7.uksecurity2">pictures</a> of the attack (creepy Big Brother shots <a href="http://news.cnet.com/2300-7348_3-6224342-1.html?tag=mncol">here</a>).  The London police doubled down on mass surveillance, but reported that the cameras <a href="http://www.guardian.co.uk/uk/2008/may/06/ukcrime1">have not reduced crime</a>.  Worse yet, the British have <a href="http://www.guardian.co.uk/commentisfree/2009/feb/16/protest-police-liberty-central">effectively outlawed taking photos of police officers</a>, prompting <a href="http://www.spiked-online.com/index.php?/site/earticle/6225/">photo</a> <a href="http://parliamentprotest.org.uk/">protests</a>.</p>
<p>Chicago isn&#8217;t the first major American city to take this route.  New York <a href="http://www.usnews.com/usnews/news/articles/070715/23cctv.htm">did so</a>, as did <a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/02/10/AR2008021002726_pf.html">the District of Columbia</a>.  The cameras in D.C. have not prevented crime, and <a href="http://www.washingtoncitypaper.com/display.php?id=36798">this piece</a> makes the case that they are a waste of resources &#8211; no one can point to a prosecution that used the camera footage to obtain a conviction, and several murders have been committed within a block of a surveillance camera.</p>
<p>Surveillance cameras can and should play a prominent role in law enforcement &#8211; mounted on officers&#8217; firearms.  A company is now producing a <a href="http://www.pistolcam.com/">camera</a> that attaches to the tactical rail found on modern pistols and rifles.  A New York county <a href="http://wcbstv.com/local/police.handgun.cameras.2.722036.html">has invested in the technology</a> for its officers, and their experience looks promising.  Putting a camera on the guns of SWAT officers will keep them honest and prevent falsification of evidence after the fact to cover up a mistaken address or unlawful use of lethal force.</p>
<p>Mayor Cheye Calvo can attest to these horrors, as detailed in a recent <em>Washington Post Sunday Magazine</em> <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/01/23/AR2009012302935_pf.html">cover story</a>, this Cato <a href="http://www.cato.org/pubs/policy_report/v30n6/cpr30n6-2.html">Policy Report</a>, and this Cato <a href="http://www.cato.org/event.php?eventid=5268">Policy Forum</a>, &#8220;Should No-Knock Police Raids be Rare-or Routine?&#8221;  Click <a href="http://www.cato.org/realaudio/cpf-09-11-08.ram">here</a> for video &#8211; Mayor Calvo calmly captures the raw shock of having your life turn into a tactical problem for a SWAT team to solve, and he is now <a href="http://www.theagitator.com/2009/02/26/live-chat-with-berwyn-heights-maryland-mayor-cheye-calvo/">advocating</a> for a Maryland state statute to <a href="http://www.baltimoresun.com/news/local/howard/bal-md.ho.raid01mar01,0,2457227.story?page=1">mandate</a> tracking the deployment of tactical law enforcement teams.  As <a href="http://www.theagitator.com/">Radley Balko</a> would tell you, this is <a href="http://www.theagitator.com/2009/02/06/maryland-bill-would-bring-transparency-to-use-of-swat-teams/">long overdue</a>.</p>
