Levy</p><p>The right answer to the same-sex marriage question is to remove government from the marriage business altogether.  That’s a legislative matter, however, and not something the courts should decree. Until then, because state and federal laws confer benefits based on marital status, the equal protection provisions of the Fifth and Fourteenth Amendments require that same-sex couples not be subject to discrimination in receipt of those benefits. But that issue was not addressed by the U.S. Court of Appeals in California—a state that permits gay unions and does not discriminate against such unions in conferring “marital” benefits. The specific issue the court decided was whether the label “marriage” could attach to heterosexual but not homosexual partnerships. Quite properly, the court ruled that it could not. That’s a narrow but important step in the right direction. But it does not settle the more significant question whether states may grant benefits to heterosexual couples while granting less or no benefits to homosexual couples.</p>
<p>In fact, there’s a negative aspect of the court’s ruling, which essentially declared Prop 8 unconstitutional because California went further than other states in allowing civil unions. The court held there&#8217;s no rational basis for allowing such unions but requiring that they carry a different label. That&#8217;s quite different from invoking the Equal Protection Clause to forbid a state from denying gays a right to the benefits of marriage. That issue didn&#8217;t arise because California grants such benefits to gays. Regrettably, other states may be dissuaded from following the California civil union model because their voters wish to limit the definition of “marriage” to exclude gays. In this instance, the better may become the enemy of the good.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>Cato today filed an <a href="http://www.cato.org/pubs/legalbriefs/AGFC-Brief.pdf"><em>amicus</em> brief</a> supporting a request that the Supreme Court review <em>Arkansas Game &amp; Fish Commission v. United States</em>.  Here&#8217;s the case:</p>
<p>The Arkansas Game &amp; Fish Commission owns and operates 23,000 acres of land as a wildlife refuge and recreational preserve; the preserve&#8217;s trees are essential to its use for these purposes. Clearwater Dam, a federal flood control project, lies 115 miles upstream. Water is released from the dam in quantities governed by a pre-approved &#8220;management plan&#8221; that considers agricultural, recreational, and other effects downstream. </p>
<p>Between 1993 and 2000, the government released more water than authorized under the plan. AGFC repeatedly objected that these excessive releases flooded the preserve during its growing season, which significantly damaged and eventually decimated tree populations. In 2001, the government acknowledged the havoc its flooding had wreaked on AGFC&#8217;s land and ceased plan deviations. By then, however, the preserve and its trees were severely damaged, so AGFC sued the government, claiming damages under the Fifth Amendment&#8217;s Takings Clause.</p>
<p>The district court awarded $5.8 million in lost timber and reforestation costs based on the substantiality of the government&#8217;s flooding and the foreseeability of the damage it caused. The Federal Circuit reversed that decision, holding that the flooding of private land can never be a taking unless that flooding is permanent. It further held that, in determining whether the government&#8217;s intrusion on AGFC&#8217;s land was permanent or temporary, courts must focus on the character of the policy behind the intrusion rather the effects of the intrusion itself. A taking cannot have occurred here because each deviation from the plan constituted a &#8220;temporary&#8221; policy, the court concluded, so AGFC had no constitutional remedy.</p>
<p>AGFC is asking the Supreme Court to review its case; the Court itself has recognized that something less than a permanent invasion of land can constitute a compensable taking. Cato joined the Pacific Legal Foundation on <a href="http://www.cato.org/pubs/legalbriefs/AGFC-Brief.pdf">a brief</a> urging the Court to hear the case and uphold the Fifth Amendment rights of property owners whose land is destroyed by the federal government. Our brief highlights the conflict between the Federal Circuit&#8217;s decision and both Supreme Court and lower court precedent. First, an invasion of land by flooding is no different from an invasion of land by any other means. Second, the government&#8217;s self-professed &#8220;intent&#8221; that a possible taking be &#8220;temporary&#8221; should have no bearing on whether a Fifth Amendment remedy exists when that taking has, in fact, occurred. Instead, the relevant inquiry should be whether the government caused permanent damage and, if so, how much.</p>
<p>The Federal Circuit&#8217;s new rule — that, so long as it might be &#8220;temporary,&#8221; no government flooding can be remedied under the Fifth Amendment — runs afoul of the letter and spirit of a constitutional provision meant to compensate property owners for government intrusions on their land. We urge the Court to grant AGFC&#8217;s petition and maintain constitutional protections for private property.</p>
<p>The Supreme Court will decide in the new year whether to take the case, and would hear argument in the fall if it does.</p>

<p>Thanks to the <a href="http://ij.org/about/4200">Institute for Justice</a>, those suffering from leukemia and various other ailments that require them to wait for a bone marrow match to miraculously appear have new hope. Yesterday’s unanimous opinion by the Ninth Circuit in <a href="http://www.ij.org/images/pdf_folder/economic_liberty/NOTA/nota_appellate-decision12-1-11.pdf"><em>Flynn v. Holder</em></a> effectively deregulates the bone-marrow market&#8212;and may even encourage lawmakers to rethink the <a href="http://www.theatlantic.com/magazine/archive/2009/07/with-functioning-kidneys-for-all/7587/">disastrous</a> federal prohibition on compensating organ donors.  (I previously wrote about the case <a href="http://www.cato-at-liberty.org/the-constitutional-right-to-save-lives/">here</a> and <a href="http://www.cato-at-liberty.org/compensating-bone-marrow-donation-isnt-the-same-as-selling-organs/">here</a>, and you can watch Cato&#8217;s forum on it <a title="http://www.cato.org/event.php?eventid=6833" href="http://www.cato.org/event.php?eventid=6833" target="_blank">here</a>.)</p>
<p>At issue here is the National Organ Transplant Act, which prohibits patients from compensating would-be donors of life sustaining organs. The Ninth Circuit ruled that NOTA does not apply to blood (or blood subparts), and so it is entirely legal to sell bone marrow stem cells if those cells are extracted from the blood&#8212;as they are in 70% of donations&#8212;instead of from the bone marrow itself.</p>
<p>Unfortunately, the Ninth Circuit rejected IJ’s argument that Congress has no legitimate authority to interfere with the right to participate in safe, accepted, lifesaving, and otherwise legal medical treatment. In rejecting this argument, the court effectively held that NOTA’s ban on the sale of actual bone marrow was constitutional because an unregulated market posed certain dangers (especially of the exploitation of desperate patients).</p>
<p>It is highly unlikely that such exploitation could occur under current market conditions, however, because donors and patients have no way of contacting each other without the National Registry system that matches them. And, of course, the choice is not between a prohibition on compensation and complete non-regulation; some regulation may be appropriate, whether by legislation or simple action of the common law akin to how it operates to prevent extortion in other contexts.</p>
<p>The good news is that, with the bone marrow market effectively deregulated, Congress may now be motivated to reexamine its misguided ban on compensating organ donors. One of the greatest obstacles to reforming the prohibition on organ sales is the fortunate fact that relatively few Americans require organ transplants in any given election cycle. According to government statistics, <a href="http://optn.transplant.hrsa.gov/">112,546</a> Americans are currently on some kind of organ transplant waiting list. That means only around 1 in 3,000 Americans (and their families and friends) would be seriously motivated to demand organ transplant reform from Congress. Congress will now be forced to grapple with its policies regarding bone marrow transplants, which may be an opportune time for advocates to push for wider organ transplant reform.</p>
<p>The Ninth Circuit’s opinion also clears the way for Supreme Court review of NOTA. If this case reaches the high court, IJ can press its constitutional arguments more forcefully. And even if the Supreme Court merely affirms the Ninth Circuit’s opinion on statutory grounds, we will inevitably learn much about the justices’ views on the <a href="http://www.harvardlawreview.org/issues/120/may07/volokh.pdf">constitutionality</a> of NOTA more broadly.</p>
<p>For the moment, <em>Flynn v. Holder</em> means that, for the first time in over 25 years, a spotlight has been shined on NOTA and its disastrous effects on Americans&#8217; medical liberty. And that is why the Ninth Circuit’s narrow bone marrow opinion may actually be a significant step toward the rational regulation of organ markets.</p>

<p>Rent control is literally a textbook example of bad economic policy. Economics textbooks often use it as an example of how price ceilings create shortages, poor quality goods, and under-the-table dealings. A 1992 survey revealed that 93 percent of economists believe that rent control laws reduce both the quality and quantity of housing.</p>
<p>As expected, therefore, New York City&#8217;s Rent Stabilization Law—the most (in)famous in the country—has led to precisely these effects: housing is scarce, apartment buildings are dilapidated because owners can&#8217;t charge enough to fix them, and housing costs have only increased (in part because costs are transferred to non-rent mechanisms such as &#8220;non-refundable deposits&#8221;). Yet the RSL persists, benefiting those grandfathered individuals who rent at lower rates but hurting the city as a whole.</p>
<p><em>Harmon v. Kimmel</em> challenges New York&#8217;s law on the grounds that it is an arbitrary and unsupportable regulation amounting to an uncompensated taking that violates the Fifth Amendment.</p>
<p>Jim Harmon&#8217;s family owns and lives in a five-story brownstone in the Central Park West Historical District. The Harmons inherited the building—and along with it three rent-controlled tenants. Those tenants have occupied apartments in the building for a combined total of 91 years at a rate 59 percent below market. In their lawsuit, however, the Harmons face many unfriendly precedents that have given states free reign to regulate property, to the point that it is occupied on an essentially permanent basis while surviving Fifth Amendment scrutiny.</p>
<p>One way to challenge some of these laws is to argue they are so arbitrary and poorly justified that they violate the Fourteenth Amendment&#8217;s Due Process Clause. Because this is an especially difficult type of challenge to bring, Cato joined the Pacific Legal Foundation and the Small Property Owners of San Francisco Institute on <a href="http://www.cato.org/pubs/legalbriefs/Harmon-brief.pdf" target="_blank">a brief</a> supporting the Harmons&#8217; request that the Supreme Court review lower-court rulings against them. Although the Court has ruled that the Takings Clause does not permit challenges based on claims that the alleged taking fails to &#8220;substantially advance legitimate state interests,&#8221; the Due Process Clause is an independent textual provision.</p>
<p>We thus clarify the relationship between property rights and due process, arguing that a law which advances no legitimate governmental purpose can be challenged under the Due Process Clause. To hold otherwise would be to deny property owners any meaningful avenue for defending their property from onerous and irrational regulations.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>One of the unambiguously good results from last Tuesday&#8217;s off-year elections came in Mississippi, the state I called home the year before I moved to D.C.  By the impressive margin of 73% to 27%, voters in the Magnolia State took a stand against judicially sanctioned eminent domain abuse, specifically the government&#8217;s taking of private property in the name of so-called “economic development.”  </p>
<p>By passing Measure 31, which prohibits most transfers of condemned land to private parties for 10 years after condemnation, Mississippi joins 44 other states in enacting legislation that strengthens property rights in the wake of the Supreme Court&#8217;s horrific ruling in <em>Kelo v. New London</em>.  In <em>Kelo</em> (2005), you&#8217;ll recall, the Court held that state and local governments can condemn private property not for some sort of public project like a highway or military base nor because it is a &#8220;blight&#8221; that creates a health or safety risk, but simply to transfer to another private party who claims to put it to better economic use. </p>
<p>We at Cato are all in favor of economic development, of course, but not if that development comes via raw government power that treads on constitutionally protected individual rights.  If a developer thinks he can put a given piece of land to a higher-value use, let him buy that property fair and square from the owner rather than effectively forcing a sale at below-market value.</p>
<p>Indeed, <em>Kelo</em>’s holding was flawed precisely because its rationale that transferring ownership of &#8220;economically blighted&#8221; property would promote economic development is bad economics. If a proposed project were actually a better use of a given property, the developer would be willing to pay a price sufficient to induce the current owners to leave.</p>
<p><em>Kelo</em> also undermines property security, making owners less willing to invest in their property and use it productively, lest the government swoop in, declare it “blighted,” and sell it to someone else. And securing property rights is not just a good thing economically.  It also helps prevent powerful private interest groups from undercutting the property rights of minorities and other groups who may be vulnerable due to prejudice or political disadvantage.</p>
<p>And the American people agree: <em>Kelo</em> turned out to be a Pyrrhic victory for developers and their public-official cronies, such that most of the country is now better protected against eminent domain abuse than it was before <em>Kelo</em>.  Notably absent from the list of states where property rights are better off, however, is New York (see <a href="http://www.cato-at-liberty.org/the-nets-finally-win/">my comment</a> on a recent instance of eminent domain abuse in the Empire State).</p>
<p>The judiciary’s abdication of its role as a protector of property rights is bad enough, but our elected officials haven’t done much better. Tellingly, the drivers of successful anti-<em>Kelo</em> legislation have tended not to be state legislators (with some exception) but rather citizen-activists.  While special-interest groups, such as big car companies in Mississippi, may pressure legislators to avoid anti-<em>Kelo</em> legislation, even as referenda show that popular opinion is on the side of the property rights activists.</p>
<p>Measure 31 is not perfect, but it is a step in the right direction. The Founders took care to protect private property rights in the Constitution, and it&#8217;s heartening to see citizens taking an active role to vindicate those protections even when the Supreme Court abdicates its duty to do so.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>When state and local governments violate federal constitutional rights (e.g., First Amendment free speech), they can be sued in federal court — except when that government action violates the Fifth Amendment&#8217;s protections for property rights.  Under the Supreme Court&#8217;s decision in <em>Williamson County v. Hamilton Bank</em>, individuals and businesses alleging unconstitutional takings by state or local governments are required to exhaust state review procedures — seeking redress from the very officials who harmed them — before turning to federal courts.</p>
<p>This constitutional anomaly is evident in <em>Colony Cove v. City of Carson</em>, where the operators of a rental property in California alleged an unconstitutional taking when the local rent control board refused to approve an increase in rent to allow their business to operate profitably. California law forecloses judicial review of the findings of rent control boards, so municipal governments have an unchecked license to determine whether such businesses may operate: A property owner&#8217;s sole recourse is to appeal to the very rent control board who forbade her from charging a profitable rent in the first place.</p>
<p>These &#8220;review&#8221; procedures, like some others across the nation, are wildly insufficient. Even more significantly, once a takings claim has been fully heard in state proceedings per <em>Williamson County</em>&#8216;s command, it is usually barred from federal review based on various prudential doctrines. The result is the indiscriminate exclusion of takings claims from federal courts, a situation that invites opportunist states to usurp private property rights.</p>
<p>Seeking to afford citizens across the nation the opportunity to assert Takings Clause claims in parity with other constitutional rights, Cato joined the New England Legal Foundation, National Federation of Independent Business, Institute for Justice, Goldwater Institute, and Professors James Ely and Richard Epstein in filing <a href="http://www.cato.org/pubs/legalbriefs/ColonyCove-brief.pdf">an <em>amicus</em> brief</a> supporting the California property owners&#8217; petition for Supreme Court review of the Ninth Circuit&#8217;s ruling against them.</p>
<p>We argue that <em>Williamson County</em> should be overruled because it relegates takings claims to second-class status despite the constitutional first principle that uniform protection of individual rights is vital to our system of government. At the very least, the Court should require federal reprieve when state procedures for rectifying a taking are futile — as they were here. Finally, we argue that the Court should correct lower courts&#8217; misinterpretation of <em>Williamson County</em>, which puts property rights jurisprudence at odds with Section 1983 of the Civil Rights Act of 1871 (a statute that gives people access to federal courts when a state denies them their constitutional rights).</p>
<p>The Court will decide whether to review <em>Colony Cove v. 			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>For over a century, Montana citizens have used non-navigable streambeds along their properties for various purposes without objection from the state government.  The hydroelectric energy company PPL Montana and thousands of other private parties exercised their rights over these non-navigable stretches that the state never claimed. </p>
<p>Last year, however, the Montana Supreme Court overturned well-settled state property law by effectively converting the title in hundreds of miles of riverbeds to state ownership. The majority of the court ruled that the entirety of the Missouri, Clark Fork, and Madison rivers were navigable at the time of Montana&#8217;s statehood, producing a broad holding that eradicates the right to use rivers and riverbanks that Montanans had enjoyed for over a century.</p>
<p>PPL Montana thus asked the U.S. Supreme Court to review the state court’s decision; Cato filed an <em><a title="http://www.cato.org/pubs/legalbriefs/PPLMontanaBrief.pdf" href="http://www.cato.org/pubs/legalbriefs/PPLMontanaBrief.pdf">amicus brief</a></em> supporting that request, which the Court granted.  Now that the case is before the Court, Cato has joined the Montana Farm Bureau Federation, American Farm Bureau Federation, and National Federation of Independent Business on <a href="http://www.cato.org/pubs/legalbriefs/PPL-MontanaLLC-v-Montana.pdf">a brief</a> supporting the property owners.</p>
<p>We are chiefly concerned with two parts of the Montana Supreme Court’s ruling:  First, the court incorrectly evaluated navigability for the purpose of establishing title &#8212; finding the entirety of the rivers at issue navigable (and thus belonging to the state) because portions of them are &#8212; contravening the legal standard established by the U.S. Supreme Court in <em>United States v. Utah</em> (which analyzed the riverbeds section-by-section to achieve a “precise” assessment of navigability).  Second, the court effectively transferred a substantial quantity of land from private owners to the state &#8212; a judicial taking that violates either the Fifth or Fourteenth Amendments (as the Court described in the recent <em>Stop the Beach Renourishment </em>case, in which Cato also <a title="http://www.cato.org/pub_display.php?pub_id=10466" href="http://www.cato.org/pub_display.php?pub_id=10466">filed a brief</a>).  </p>
<p>In short, the Court should reaffirm the <em>Utah</em> standard for navigability in the context of establishing title and protect private property owners against judicial takings.  By doing so, it would send a strong message to state courts across the nation that judicial usurpations of property rights are just as unconstitutional as those undertaken by other branches of government.</p>

Today we mark a major event in that struggle, the day in 1215 when English barons presented King John with a written list of rights they demanded he recognize. Known ultimately as Magna Carta, the Great Charter, it was a compact between the barons and their king, a political effort by subjects to secure their liberty by placing their ruler under the rule of law, thus limiting arbitrary power.</p>
<p>The charter has gone through several iterations, but it drew in part from the common law rights, especially rights of property, that judges in the king’s courts had been finding from reason and custom as they decided controversies the king’s subjects brought before them. What Magna Carta did was bring those same rights against the king. Most important for us today was the promise found in clause 29:</p>
<blockquote><p>No freeman shall be taken or imprisoned or deprived of his freehold or of his liberties or free customs, or outlawed, or exiled, or in any manner destroyed, nor shall we go upon him, nor shall we send upon him, except by a legal judgment of his peers or by the law of the land.</p></blockquote>
<p>Note first the broad terms of clause 29: that enabled it to apply not just to the issues at hand but to varied future situations. Second, notice that only “freemen” were protected. The barons came to realize, however, that if their rights were to be maintained against the king, they would need the cooperation of all classes. Thus, the charter came in time to protect “common” liberties.</p>
<p>Each of those issues has informed the American experience. First, Magna Carta itself inspired our Founders to limit power through a written document, our Constitution. Second, clause 29 is captured in the Fifth Amendment, which provides that no person shall be deprived of life, liberty, or property, without due process of law. And third, Magna Carta’s capacity to grow is reflected by the post-Civil War inclusion of the Due Process Clause in the Fourteenth Amendment. That brought the Bill of Rights to bear not only against the federal government, its original limit, but against the states as well. We owe much to this English inheritance.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>Last month, I <a href="http://tinyurl.com/434r2ek">wrote about</a> a major eminent domain struggle in National City, California.  City officials had decided to declare almost seven hundred properties blighted even before conducting any sort of blight study, which eventually turned out to be riddled with errors. </p>
<p>At the center of the fight is a private, nonprofit boxing gym that has helped keep hundreds of at-risk kids in school and off the streets.  The city wanted to bulldoze the center so a wealthy developer can build luxury condos and stores. </p>
<p>In 2007, the Institute for Justice teamed up with the gym and filed suit to stop the city from taking the property, and here&#8217;s video about their legal fight:</p>

<p>Four years later, IJ scored a knockout blow against eminent domain abuse:  Last Thursday, the Superior Court of California struck National City&#8217;s entire 692-property eminent domain zone and found that National City lacked a legal basis for its blight declaration.  </p>
<p>This is a major victory for California property owners, and the first case to apply the property reforms that the state enacted to counter the 2005 <em>Kelo</em> decision.  Learn more <a href="http://www.ij.org/about/3779">about the victory here</a>.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>As <a href="http://www.cato-at-liberty.org/the-takings-clause-has-no-expiration-date/">I wrote last week</a>, a decade ago in <em>Palazzolo v. Rhode Island</em>, the Supreme Court rejected the idea that those who buy property subject to burdensome regulations lose the right the seller otherwise has to challenge those regulations.  The Court ruled that the Takings Clause does not have an &#8220;expiration date.&#8221;  Sadly, not all government authorities or courts took <em>Palazzolo</em> to heart, and now we have a second such case meriting Cato&#8217;s involvement in the span of a week.</p>
<p>In 2000, after the EPA issued a Record of Decision concerning limiting access to a &#8220;slough&#8221; (a narrow strip of navigable water) on its Superfund National Priorities List, CRV Enterprises began negotiations to buy a parcel of land next to the slough across from a site once occupied by a wood-preserving plant.  CRV hoped to develop that parcel and others it already controlled into a mixed-use development, including a marina, boat slips, restaurants, lodging, storage, sales, and service facilities.  The company eventually bought the land with notice of the EPA&#8217;s ROD but the EPA later installed a &#8220;sand cap&#8221; and &#8220;log boom&#8221; that obstructed CRV&#8217;s access to the slough.</p>
<p>CRV sued the United States in the Court of Federal Claims, which dismissed the case for lack of standing. The Federal Circuit affirmed, finding that CRV&#8217;s claim &#8220;is barred because [the company] did not own a valid property interest at the time of the alleged regulatory taking.&#8221;  The Federal Circuit thus turned two Supreme Court precedents on their head and put that &#8220;expiration date&#8221; on the Takings Clause.  It did so despite the fact that multiple federal courts have upheld <em>Palazzolo</em>&#8216;s rule and that longstanding California common law recognizes that a littoral (next to water) owner&#8217;s access to the shore adjacent to his property is a property right.</p>
<p>Cato, joined by Reason Foundation, the Center for Constitutional Jurisprudence, and the National Federation of Independent Business, <a href="http://www.cato.org/pubs/legalbriefs/CRV-brief.pdf">filed an amicus brief</a> supporting CRV&#8217;s request that the Supreme Court review the Federal Circuit&#8217;s decision and reaffirm <em>Palazzolo</em>.  We argue the following: (1) when post-enactment purchasers are per se denied standing to challenge regulation, government power expands at the expense of private property rights; (2) a rule under which pre-enactment owners have superior rights to subsequent title-holders threatens to disrupt real estate markets; (3) the Federal Circuit abrogated the rule of <em>Palazzolo</em>; and (4) this case — viewed in the context of other courts&#8217; rulings — indicates the need for the Supreme Court to settle the spreading confusion about <em>Palazzolo</em>.  Otherwise, the existence of a &#8220;post-enactment&#8221; rule will create a &#8220;massive uncompensated taking&#8221; from small developers and investors that would preserve and enhance the rights of large corporations.</p>
<p><em>Palazzolo</em> put to rest &#8220;once and for all the notion that title to property is altered when it changes hands.&#8221;  The ability of property owners to challenge government interference with their property is essential to a proper understanding of the Fifth Amendment; the Court must reestablish the principle that transfer of title does not diminish property rights.  Significantly, the Federal Circuit isn&#8217;t alone in its misapplication of <em>Palazzolo</em>; the Ninth Circuit in <em>Guggenheim v. City of Goleta</em> (in which Cato also <a href="http://www.cato.org/pubs/legalbriefs/Guggenheim-brief.pdf">filed a brief</a>) recently issued an opinion severely narrowing <em>Palazzolo</em>&#8216;s scope and deepening a circuit split.</p>

Rhode Island</em>, the Supreme Court rejected the idea that those who buy property subject to burdensome regulations lose the right the seller otherwise has to challenge those regulations. The Court ruled that the Takings Clause does not have an &#8220;expiration date.&#8221;</p>
<p>Sadly, not all government authorities or courts took <em>Palazzolo</em> to heart. In 1997, Daniel and Susan Guggenheim bought a mobile home park that, at the time of purchase, was in &#8220;unincorporated territory&#8221; of Santa Barbara County, California. The Guggenheims did not challenge the county&#8217;s 1979 rent control ordinance but instead challenged the 2002 adoption of that ordinance by the City of Goleta when the city incorporated the Guggenheims&#8217; land.</p>
<p>The Ninth Circuit essentially limited <em>Palazzolo</em> to its particular facts and circumstances, deciding to convert the established three-factor test for regulatory takings (<em>Penn Central</em>) into a one-factor test focused solely on &#8220;investment-backed expectations.&#8221; The court did this largely on the premise that the Guggenheims did not present an &#8220;as-applied&#8221; challenge — as <em>Palazzolo</em> did — to the ordinance&#8217;s application to their mobile home park, but instead filed a facial challenge to the constitutionality of the ordinance itself. As a result, the Ninth Circuit turned two Supreme Court precedents on their head and put that &#8220;expiration date&#8221; on the Takings Clause in this case.</p>
<p>Significantly, the Ninth Circuit isn&#8217;t alone in its misapplication of <em>Palazzolo</em>; the Federal Circuit in <em>CRV Enterprises v. United States</em> (in which Cato will also be filing a brief) also recently issued an opinion severely narrowing <em>Palazzolo</em>&#8216;s scope and deepening a circuit split.</p>
<p>Cato filed <a href="http://www.cato.org/pubs/legalbriefs/Guggenheim-brief.pdf" target="_blank">an amicus brief</a> supporting the Guggenheims&#8217; request that the Supreme Court review the Ninth Circuit decision and reaffirm its decision in <em>Palazzolo</em>. The brief argues the Supreme Court should review the case because: (1) a rule that allows the transfer of title to immunize government regulation from constitutional or other legal challenge expands government power and diminishes property rights; (2) the Ninth Circuit &#8220;flouts&#8221; the rule of <em>Palazzolo</em>; and (3) this case — as well as <em>CRV Enterprises</em> — indicates the need for the Supreme Court to settle the spreading confusion about Palazzolo.</p>
<p>Otherwise, the existence of a &#8220;post-enactment&#8221; rule will create a &#8220;massive uncompensated taking&#8221; from small developers and investors that would preserve and enhance the rights of large corporations. The ability of property owners to challenge government interference with their property is essential to a proper understanding of the Fifth Amendment; the Court must reestablish the principle that transfer of title does not diminish property rights.</p>

<p><em>First</em>, National City, California, is ground zero for eminent domain abuse.  City officials declared several hundred properties blighted even before conducting a blight study that was riddled with problems. The city wants to seize and bulldoze a youth community center (CYAC) that has transformed the lives of hundreds of low-income kids, so a wealthy developer can build high-rise luxury condos:</p>

<p>CYAC has numerous volunteers, including local law enforcement officers, providing free mentoring in boxing as well as academics.  The gym is famous for getting kids off the street and back into school.  As Rick Reilly <a href="http://sportsillustrated.cnn.com/vault/article/magazine/MAG1107877/index.htm">explained in a feature</a> in <em>Sports Illustrated</em> (boy, how I miss his inside-back-page column):</p>
<blockquote><p>You know what, Mayor? National City doesn&#8217;t need more luxury condos. It needs good men like the Barragans teaching kids respect for neighbors and property, manners you could use a little of yourself.</p>
<p>And if you kick the Barragans out so some slick in Armani can buy a bigger yacht, I hope your car stereo gets jacked—weekly—by a kid who would&#8217;ve otherwise been lovingly coached on their jabs and their math and their lives.</p>
<p>Question: Can you declare politicians blighted?</p></blockquote>
<p>This week, the gym’s battle is in trial before the Superior Court of California.  Represented by the <a href="http://ij.org/">Institute for Justice</a> (who else?), a victory will help protect private property far beyond National City and clarify the use and misuse of blight designations.</p>
<p><em>Second</em>, moving to the other side of the country, we go to Mount Holly, New Jersey:</p>

<p>Mount Holly is another classic case of &#8220;Robin Hood-in-Reverse.&#8221;  Officials have been dismantling a close-knit community known as the Gardens for the last decade so a Philadelphia developer can bulldoze the area and build more expensive residential properties.</p>
<p>Homeowners in the Gardens are primarily minorities and the elderly.  The row-style houses are being torn down while still attached to occupied homes, and officials refuse to offer the remaining homeowners replacement housing in the new redevelopment.  Further, owners are being offered less than half the amount it would cost to buy a similar home blocks away.</p>
<p>Here, IJ just launched a <a href="http://www.ij.org/about/3665">billboard campaign</a> and <a href="http://www.ij.org/images/pdf_folder/castlecoalition_PDF/mh_analysis.pdf">did a study</a> that concludes the eminent domain abuse project may result in a <em>loss</em> of a million taxpayer dollars a year, or one-tenth of the Township’s budget.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>Last term, <a href="http://www.cato-at-liberty.org/mixed-result-in-complicated-property-rights-case/">the Supreme Court decided</a> what could end up being an important precedent for protecting property rights &#8212; even as the Court ruled unanimously against the property owners in that particular case!  How is this possible?  Read the new article by Cato legal associate Trevor Burrus and me, &#8220;<a href="http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1652293">Judicial Takings and Scalia&#8217;s Shifting Sands</a>.&#8221;</p>
<p>Here&#8217;s the background:  Seeking to restore beaches damaged by hurricanes, the Florida Department of Environmental Protection began dredging sand from the Gulf of Mexico ocean floor and transporting it to Florida&#8217;s gulf coast. The expanded area of the beach became state property, depriving beachfront landowners of their littoral rights. In reviewing the landowners&#8217; lawsuit against the state, the Florida Supreme Court (SCOFLA, if you remember your <em>Bush v. Gore</em> trivia) departed from long-established state law principles protecting littoral property rights and held that littoral rights are an ancillary concept subsumed by the right of access. In so doing, the court effectively discarded 100 years of property law and rewrote the definition of property.</p>
<p>The U.S. Supreme Court had never formally addressed whether state court rulings eliminating formerly established property rights can effect a taking, or violate an owner&#8217;s due process rights, under the Fifth and Fourteenth Amendments to the U.S. Constitution. Cato joined the National Federation of Independent Business Small Business Legal Center and the Pacific Legal Foundation on <a href="http://www.cato.org/pubs/legalbriefs/stop-beach-renourishment-v-florida-department-environmental-protection.pdf">a brief supporting the landowners</a>.</p>
<p>In June, Court finally decided <em>Stop the Beach Renourishment v. Florida Department of Environmental Protection</em>.  The decision waded through a jumbled mass of arcane waterfront law to reach a very simple and unanimous holding: the Florida Supreme Court did not subvert an existing property right to such an extent that its decision constituted a “judicial taking.”  The state won.  The property owners lost.  SCOFLA was vindicated.</p>
<p>Still, while all eight justices ultimately ruled for the state &#8212; Justice Stevens recused himself because his Florida property is subject to the renourishment program &#8212; six accepted the idea that judges can violate the Constitution by reinterpreting pre-existing property rights (albeit under two different theories), and the other two declined to reach the question.  Although the <em>Stop the Beach</em> Court found that SCOFLA had not departed from sufficiently established state property law to constitute a taking, the idea of a judicial taking &#8212; whether through the Fifth Amendment’s Takings Clause or the Fourteenth Amendment’s Due Process Clause &#8212; is very much alive.</p>
<p>And that&#8217;s where <a href="http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1652293">our article in the <em>Vermont Law Review</em></a> picks up.  In this article, Trevor and I examine the background of the judicial takings doctrine, react to the Court&#8217;s decision here in light of Cato’s amicus brief, and contrast Justice Scalia’s views of Substantive Due Process as expressed in <em>Stop the Beach</em> with that in another high-profile case whose plurality opinion he joined, <em>McDonald v. City of Chicago</em>, to argue that the judicial takings doctrine is necessary to a robust constitutional protection of property rights.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>Five years ago, in the landmark property rights case of <em>Kelo v. New London</em>, the Supreme Court upheld the forced transfer of land from various homeowners by finding that “economic development” qualifies as a public purpose for purposes of satisfying the Fifth Amendment’s Takings Clause.  In doing so, however, the Court reaffirmed that the government may not “take property under the mere pretext of a public purpose, when its actual purpose was to bestow a private benefit.”</p>
<p>State and federal courts have since applied that pretext standard in widely differing ways while identifying four factors as indicators of pretext: evidence of pretextual intent, benefits that flow predominantly to a private party, haphazard planning, and a readily identifiable beneficiary.  Moreover, since <em>Kelo</em>, 43 states have passed eminent domain reform laws that constrain or forbid “economic development” condemnations.</p>
<p>While many of these laws are strong enough to curtail abuse, in at least 19 states the restrictions are undercut by nearly unlimited definitions of “blight.”  The state of New York has seen perhaps the most egregious examples of eminent-domain abuse in the post-<em>Kelo</em> era, and now provides the example of Columbia University’s collusion with several government agencies to have large swaths of Manhattan declared blighted and literally pave the way for the university’s expansion project.  In this brazen example of eminent-domain abuse, the New York Court of Appeals (the highest state court) reversed a decision of the New York Appellate Division that relied extensively on <em>Kelo’s</em> pretext analysis and thus favored the small business owners challenging the Columbia-driven condemnations.  The Court of Appeals failed even to cite <em>Kelo</em> and ignored all four pretext considerations, instead defining pretext so narrowly that even the most abusive forms of favoritism will escape judicial scrutiny.</p>
<p>Cato joined the Institute for Justice and the Becket Fund for Religious Liberty in a brief supporting the condemnees’ request that the Supreme Court review the case and address the widespread confusion about <em>Kelo</em>’s meaning in the context of pretextual takings.  Our brief highlights the need for the Court to establish and enforce safeguards to protect citizens from takings effected for private purposes.  We argue that this case is an excellent vehicle for the Court to define what qualifies a taking as “pretextual” and consider the weight to be accorded to each of the four criteria developed by the lower and state courts.</p>
<p>The Supreme Court will decide whether to hear the case later this fall. The name of the case is <em>Tuck-It-Away, Inc. v. In the latest case in which Cato has filed an amicus brief, a state has once again redefined property rights to take possession of highly-valued beachfront property.</p>
<p>In 2003, Hawaii passed Act 73, which took past and future title to accretions (the slow build-up of sediment on beaches) from landowners and gave it to the State, changing a 120-year-old rule. While waterlines are unpredictable, the original rule — common to most waterfront jurisdictions — helped establish legal consistency. Indeed, without such a rule, beachfront property becomes beachview property in just a few years.</p>
<p>In response to Act 73, homeowners sued the state, claiming that the law violated the Takings Clause of the Fifth Amendment or, in the alternative, the Due Process Clauses of the Fifth and Fourteenth Amendments. The state appellate court held that compensation was owed only for the accretions that had accumulated before Act 73&#8242;s enactment because the right to subsequent accretions had not &#8220;vested&#8221; (the legal term for when an expectation becomes an actual property right). Hawaii&#8217;s Supreme Court declined to review that ruling, so the property owners asked the U.S. Supreme Court to do so.</p>
<p>Cato, joined by the Pacific Legal Foundation, <a href="http://www.cato.org/pubs/legalbriefs/MaunaluaBayBrief.pdf">filed a brief</a> supporting that petition and argues that the appellate court&#8217;s decision was contrary to long-standing definitions of waterfront property rights. Our brief highlights the increasing need for the Court to establish and enforce a judicial takings doctrine.</p>
<p>More and more states are using backdoor tricks — like legislative &#8220;guidelines&#8221; and judicial creativity — to take property in violation of constitutional rights: This Hawaii case is distressingly similar to last term&#8217;s <em>Stop the Beach</em> (in which Cato also <a href="http://www.cato.org/pub_display.php?pub_id=10466">filed a brief</a>). In that case, Florida took property by adding sand to the beach and then laying claim to the newly created land — in essence asserting that property that was <em>defined</em> by contact with the water (in technical terms, &#8220;littoral&#8221; or &#8220;riparian&#8221;) had no right to contact the water. The Court ruled that while Florida&#8217;s actions did not rise to the level of a judicial taking, a large enough departure from established common-law rules could constitute a constitutional violation.</p>
<p>In this latest brief, we highlight both the largeness of Hawaii&#8217;s departure from established law and the spate of such actions in recent years — which circumstance calls out for Supreme Court review.  The case is <em>Maunalua Bay Beach Ohana 28 v. Hawaii</em> and the Court will decide later this fall whether to take it up.</p>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>The Montana Supreme Court overturned more than 100 years of state property law concerning navigable waters by effectively converting the title in hundreds of miles of riverbeds to the State. The majority of that court ruled that the entirety of the Missouri, Clark Fork, and Madison rivers were navigable at the time of Montana&#8217;s statehood, producing a broad holding that eradicates property rights to the rivers and riverbanks that Montanans had enjoyed for over a century.</p>
<p>Before this case, the hydroelectric energy company PPL Montana and thousands of other private parties exercised their property rights over these non-navigable stretches that the state never claimed.  Today, Cato <a href="http://www.cato.org/pubs/legalbriefs/PPLMontanaBrief.pdf">joined a brief</a> filed by the Montana Farm Bureau Federation supporting the PPL Montana&#8217;s request that the U.S. Supreme Court review the Montana high court&#8217;s ruling for possible Takings Clause violations under the Fifth Amendment.</p>
<p>We argue two main points.  First, that the Court should adhere to its standard for navigability rights set out in <em>Utah v. U.S.</em> in 1933. Unlike the approach taken by the Montana Supreme Court&#8217;s majority — that entire rivers were navigable simply because certain reaches of the river were navigable — the U.S. Supreme Court in Utah used an approach of meticulously analyzing the rivers at issue section-by-section. Second, this arbitrary ruling against rights long protected by Montana law amounts to a &#8220;judicial taking,&#8221; as explained last term <em>Stop the Beach Renourishment v. Florida Dept. of Environmental Protection</em> (in which Cato also <a href="http://www.cato.org/pubs/legalbriefs/stop-beach-renourishment-v-florida-department-environmental-protection.pdf">filed a brief</a>). There, a plurality of the Court held that there is no &#8220;textual justification&#8221; for limiting takings claims deriving from executive or legislative action, thereby extending it to a judicial action of the same nature (and two other members of the Court found potential relief in the Fourteenth Amendment&#8217;s Due Process Clause). Here, the Montana court did exactly that, violating due process rights that the Montana legislature could not and further violating the procedural due process rights of the thousands harmed by the decision in not affording them notice or a hearing.</p>
<p>The U.S. Supreme Court should thus review the case to reinforce its <em>Utah</em> precedent and ensure that arbitrary judicial takings of this sort cannot continue.  The name of the case is <em>PPL Montana, LLC v. Montana.</em>  The Court will decide later this fall whether to take it up.</p>

<p>This is happening right now in Montgomery, Ala., and here is how it works: The city decides it doesn’t like your property for one reason or another, so it declares it a “public nuisance.”  It mails you a notice that you have 45 days to demolish your property, at your expense, or the city will do it for you (and, of course, bill you).</p>
<p>Your tab with the city will constitute a lien on your property, and if you don’t pay it within 30 days . . . the city can sell your now-vacant land to the highest bidder.</p></blockquote>

			<content:encoded><![CDATA[<p>By Ilya Shapiro</p><p>With all the <a href="http://www.cato-at-liberty.org/2010/06/17/mixed-result-in-complicated-property-rights-case/">property rights news</a> coming out of the <a href="http://www.cato-at-liberty.org/2010/06/18/more-on-property-rights-plus-privileges-immunities-due-process/">Supreme Court</a> and <a href="http://www.cato-at-liberty.org/2010/06/24/no-ones-property-is-safe-in-new-york/">New York Court of Appeals</a> in the last week, I almost missed Wednesday&#8217;s fifth anniversary of the dreadful <em>Kelo v. New London </em>decision.<em>  </em>Justice Stevens&#8217;s <em> </em>opinion in <em>Kelo</em> sanctioned a transfer of private property from homeowners to a big company in the name of (promised but, as we&#8217;ve seen, <a href="http://www.cato-at-liberty.org/2009/11/09/taking-land-for-public-uselessness/">never realized</a>) job creation and increased tax revenue. </p>
<p>This was a Pyrrhic victory for eminent domain abusers, however, given:</p>
<ul>
<li>9 state high courts have limited eminent domain powers;</li>
<li>43 state legislatures have passed greater property rights reform;</li>
<li>44 eminent domain abuse projects have been defeated by grassroots activists;</li>
<li>88 percent of the public now believes that property rights are as important as free speech and freedom of religion.</li>
</ul>

<p>An interesting side note involves Justice Scalia&#8217;s excoriation of Substantive Due Process (and Justice Kennedy&#8217;s use of it):</p>
<blockquote><p>Moreover, and more importantly, JUSTICE KENNEDY places no constraints whatever upon this Court. Not only does his concurrence only think about applying Substantive Due Process; but because Substantive Due Process is such a wonderfully malleable concept, see, e.g., Lawrence v. Texas, 539 U. S. 558, 562 (2003) (referring to “liberty of the person both in its spatial and in its more transcendentdimensions”), even a firm commitment to apply it would bea firm commitment to nothing in particular.</p>
<p>…</p>
<p>The great attraction of Substantive Due Process as a substitute for more specific constitutional guarantees is that it never means never—because it never means anything precise.</p></blockquote>
<p>Scalia also calls Kennedy&#8217;s method &#8220;Orwellian&#8221;  &#8212; after having said that Justice Breyer uses a &#8220;Queen-of-Hearts&#8221; approach &#8220;reminiscent of the perplexing question how much wood would a woodchuck chuck if a woodchuck could chuck wood?&#8221;  Really, this is classic Scalia, a delight to read (<a href="http://www.supremecourt.gov/opinions/09pdf/08-1151.pdf">and you should, here</a>).</p>
<p><span id="more-16690"></span>The problem with what Scalia says, as <a href="http://joshblackman.com/blog/?p=4639">Josh Blackman points out</a>, is that the Court is about to release its opinion in the Chicago gun case, <em>McDonald v. Chicago</em> and, based on the oral argument, <a href="http://joshblackman.com/blog/?p=4648">is about to incorporate the Second Amendment via Substantive Due Process</a>.  If SDP is so bad, how can Scalia (endorsed by Chief Justice Roberts and Justices Thomas and Alito) use it to protect a &#8220;new&#8221; right? &#8212; particularly when the Privileges or Immunities Clause was created for just this purpose!  One answer is that, to Scalia, &#8220;babble&#8221; &#8212; his term for SDP &#8211; is still worth more than &#8220;flotsam&#8221; (his term for P or I), <a href="http://www.cato.org/pubs/policy_report/v32n3/cpr32n3-4.html">as I discuss here</a>.  Another is that, to put it bluntly, Scalia is a results-oriented non-originalist, <a href="http://www.cato.org/pub_display.php?pub_id=11431">as Josh and I discuss here</a>.</p>

<p>Tim also recently wrote a book defending economic liberties (which Justice Scalia also disparages in his <em>Stop the Beach</em> opinion), called <em><a href="http://store.cato.org/index.asp?fa=ProductDetails&amp;method=&amp;pid=1441465">The Right to Earn a Living: Economic Liberty and the Law</a></em>.  I hear it makes for good beach reading.</p>

Florida Department of Environmental Protection</em>, a case I previously blogged about <a href="http://www.cato-at-liberty.org/2009/12/02/likely-supreme-court-tie-would-be-a-loss-to-property-owners/">here</a> and <a href="http://www.cato-at-liberty.org/2009/09/02/beach-v-florida/">here</a>, and in which Cato <a href="http://www.cato.org/pubs/legalbriefs/stop-beach-renourishment-v-florida-department-environmental-protection.pdf">filed a brief</a>.</p>
<p>While the Court’s <a href="http://www.supremecourt.gov/opinions/09pdf/08-1151.pdf">8-0 ruling</a> against the Florida oceanfront (now ocean-view) property owners was not the result we wanted, the part of the decision that was unanimously unfortunate turned on a narrow and probably mistaken interpretation of state property law.  Much more importantly, the remainder of <a href="http://www.supremecourt.gov/opinions/09pdf/08-1151.pdf">Justice Scalia’s opinion</a> makes clear that judicial takings are just as much a violation of the Fifth Amendment as any other kind.  “If a legislature or a court declares that what was once an established right of private property no longer exists,” Scalia writes for a four-justice plurality, “it has taken that property, no less than if the State had physically appropriated it or destroyed its value by regulation.”   And the test for whether the government—any part of it—has committed a taking turns on “whether the property right allegedly taken was established.” </p>
<p>Moreover, that the Court ultimately found no taking here should provide no succor to courts and other state actors who wish to abuse property rights in the future.  The case could have easily swung the other way in a non-oceanfront circumstance or under a different state’s laws.  Indeed, two justices (Kennedy and Sotomayor) said that federal courts can still police judicial takings—under a different name—by using the Fourteenth Amendment’s Due Process Clause, while the remaining two (Breyer and Ginsburg) decided to leave the question for another day.  Nobody accepted outright the idea that courts cannot be held accountable for subverting property rights!</p>
<p>In short, state courts are now on notice that they violate long-held property rights at their peril.</p>
