Arne Duncan, Secretary of Wheel Reinvention
The final guidelines for the Administration’s “Race to the Top” education reform program have now been released. It’s a system that stimulates competition between the states to produce results that the customer (Secretary Duncan) wants, using financial incentives. Déjà vu, anyone?
It’s as though Arne Duncan recognizes the merits of free market forces, but rather than faithfully reproducing them in the field of education, he’s decided to give us his own reimagining of them.
Here’s the problem. There are already 25 years of scientific research comparing real free education markets to traditional public school systems. It overwhelmingly finds that markets do a better job of serving families. But we have no evidence at all that Secretary Duncan’s newly invented system will do anyone any good.
So why go to all this trouble to reinvent the wheel, when the Secretary’s own Department of Education has found that an on-going federal private school choice program—which gets much closer to a genuine education marketplace—is raising students’ reading ability by two grade levels after just 3 years of participation?
As The Dems Turn (To School Choice)
We’ve been writing a fair amount over the last several months about increasing support for school choice among members of the Democratic Party. The focus has typically been on legislators, but a new report from the Center for Education Reform give a glimpse into possible widespread support among private-schooling Dems and Dem donors in Washington, DC.
The Trustees delves into the political affiliations of board of trustee members of the “ten most prestigious private schools that support the D.C. Opportunity Scholarship Program.” Based on trustees’ total donation amounts to the two major presidential candidates in 2008, or to candidates, party committees, and parties themselves, the report suggests that trustees lean Democratic by a ratio of roughly 9 to 1.
Importantly, only about 37 percent of trustees were found to have made any contributions, so the 9-to-1 ratio doesn’t necessarily mean that trustees overall are similarly skewed. In addition, the underlying assumption seems to be that if the schools participate in the voucher program their trustees support school choice, which doesn’t necessarily follow. A trustee may very well think a school should take some voucher kids but also think the program ought not to exist. And, of course, trustees almost certainly don’t all agree one way or the other.
Those things said, this is yet more evidence supporting an increasingly inescapable conclusion: Democrats — who have historically opposed school choice much more so than Republicans — are finding that they just can’t do it anymore. There is no justification for consigning kids to awful schools.
Of course, members of both parties — or no party at all — who support only small, hamstrung programs still have a lot of thinking to do…
The Other Side Plays Dirty
On the day that we honor veterans for defending our freedom, I read this:
Community groups and Los Angeles Unified officials on Tuesday condemned an anonymous flyer handed to Latino parents that threatened them with deportation if they supported plans to convert their neighborhood school to a charter.
Calling it an escalation in a series of “scare tactics,” district officials and community advocates said distribution of the flyer was timed to weaken one of LAUSD’s boldest efforts to reform public education in Los Angeles.
A generation or two from now, when children are studying how school choice began to spread throughout America, they will read of such incidents and marvel at the depths to which opponents sunk.
If you’re a policymaker or opinion leader, on which side of that history will you want your name to appear?
Just Say “No” to Competition
The Democrats who still control the Virginia State Senate (which wasn’t on the ballot this week) say they want to work with the new Republican governor.
“I won’t be like the House Republicans were, where anything they propose is bad,” said Senate Majority Leader Richard L. Saslaw (D-Fairfax), who like many Democrats says the GOP-led House obstructed the agenda of Gov. Timothy M. Kaine (D). “If there are areas where we can work things out, I’m ready, willing and able, and so is my caucus.”
But not so fast:
But asked about certain key pieces of McDonnell’s agenda, Saslaw demurred. Selling state-run liquor stores to raise money for transportation, for instance, would sacrifice the annual revenue the stores provide to schools and other purposes, Saslaw said. The Senate’s education committee remains opposed to changing state laws to allow more charter schools, another McDonnell proposal, he said.
No to bipartisan cooperation, no to competition, yes to hoary monopolies. Is that really the rock on which the Democrats want to make their stand as the country’s “implicit libertarian synthesis” yields a “libertarian moment”?
Why National Democrats are Like Wile E. Coyote
Illinois state senator James Meeks, an African American Democrat and long-time opponent of school choice, just switched sides.
In doing so, he swells the small but growing ranks of Democrats in Florida, New Jersey, and the nation’s capital, among others, who support giving parents an easy choice between public and private schools.
Like Wile E. Coyote, national Democrats have run off a political cliff in their reflexive opposition to educational freedom. And like Wile, they’re experiencing a temporary suspension of the law of gravity — not yet suffering for their mistake.
But we all know that the cloud at Wile’s feet eventually dissipates, and he realizes that he’s no longer on solid ground. By then, it’s too late.
As someone much happier under divided government than one party rule, I hope national Democratic leaders get a clue, and notice that the’ve left solid ground on education. There is still time for Obama and company to make it back to the cliff’s edge, calling for the expansion rather than the termination of DC’s K-12 scholarship program, and voicing support for education tax credits at the state level, as many of the party’s state leaders have already done.
States are going to continue passing and expanding private school choice programs with or without the support of national Democrats. If president Obama and friends continue clinging to the anvil of government schooling while that happens, we all know how it’s going to turn out.

Attorney General Tries to Silence School Choice Ad
This, finally, is too much: Eric Holder, Attorney General of the United States, walked up to former DC Councilman Kevin Chavous at an event and told him to pull an ad criticizing the administration for its opposition to the DC school voucher program. The Attorney General of the United States!
This is as outrageous and shameful as it is consistent with other administration hostilities toward free speech (see also here) and freedom of the press.
There is a deep revulsion to such behavior in this country. It is not a Republican or a Democratic revulsion, it is an American one. Obama administration officials seem not to understand that, but voters will help them get the message the next time they go to the polls.
New York Mayor Opposes Closing Schools for Muslim Holidays
I have been trying for years to make people understand that a single system of government schools is fundamentally at odds with American values, especially individual liberty and equal treatment under the law. New York City Mayor Michael Bloomberg, in opposing a move to let city public schools close for Muslim holidays as they do for Christian and Jewish holidays, recently made my point in one, simple sentence:
One of the problems you have with a diverse city is that if you close the schools for every single holiday, there won’t be any school.
Exactly. So which religions, and which people, will get to be more equal than others, Mr. Mayor?
With universal school choice, we wouldn’t have to grapple with such terrible questions.
Staid Speech Is Cold Comfort
After all of the rancor last week over his planned back-to-school address, it was predictable that in the end President Obama would offer a largely non-controversial speech about working hard and staying in school. If he sticks to the text released today, that is pretty much what he will do. Unfortunately, whether or not that was his original intent – and no one knows for sure but the President and his advisors – many Obama supporters will likely use the relatively staid final product as grounds to smear people concerned about the speech as right-wing kooks or out-of-control partisans. At the very least, such an outcome would be in keeping with a lot of the email I’ve gotten since the story first broke. But it will miss several critical points:
- No matter how innocuous the content of the speech, this could certainly be an address with very political goals, intended to cast the president in the warm glow of a man who just cares about kids. From kissing babies, to photo-op reading sessions featuring cute tikes on classroom floors, this could be just another instance of the old practice of using children as props for political gain. And how presumptuous of the president to make himself – rather than the children, their teachers, and their schools – the center of attention on what is the first day of school for millions of kids. Finally, add the parts of the speech that sound like the President patting himself on the back for overcoming difficulties as a youth, and the speech could easily have political aims.
- Many people feared, thanks to politically and ideologically suggestive lesson guides created by the U.S. Department of Education, that the speech would be an effort at indoctrination. Critically, it was only after very loud, initial outrage that the Department made changes to the guides and the White House announced it would release the text of the speech ahead of time. Yet administration defenders act like everyone knew from the outset that the speech would just be about working hard and staying in school. And who knows what the speech might have looked like had there not been so negative an initial reaction.
- Despite its generally innocuous tone, the speech does contain some controversial political and ideological assertions, including that “setting high standards, supporting teachers and principals, and turning around schools” is the job of the federal government. Also, the things the President highlights as worthy aspirations are disproportionately government and non-profit work. And then there’s this self-aggrandizing assertion: “Your families, your teachers, and I are doing everything we can to make sure you have the education you need to answer these questions. I’m working hard to fix up your classrooms and get you the books, equipment and computers you need to learn.”
- Ultimately, no matter what happens now that the speech has been published, one thing cannot be ignored or spun: When government controls education, wrenching political and social conflict is inevitable. Americans are very diverse – ideologically, ethnically, morally, religiously – but they all have to support a single system of government schools. As a result, they are constantly forced to fight to have their values and desires respected, and the losers inevitably have their liberty infringed. In this case, reasonable people who want their children to hear the President must fight it out with equally reasonable people who do not want their children to watch the speech in school. It’s a situation completely at odds with a free society, but as we have seen not just with the current conflict, but seemingly endless battles over history textbooks, the teaching of human origins, sex education, and on and on, it is inevitable when government runs the schools. Which is why the most important lesson to be learned from this presidential-address donnybrook is that Americans need educational freedom. We need universal school choice or crippling conflicts like this will keep on coming, liberty will continue to be compromised, and our society will be ripped farther and farther apart.

Captain Louis Renault Award: Politics in Government Schools?!*
As Neal and Andrew have already covered extensively, President Obama is set to address the nation’s school children, and the Secretary of Education has sent out marching orders to government teachers and lesson plans for the kids.
The administration has now backpedaled from a classic political gaffe and cleaned up the most offensive aspects; asking kids to write about how they can help, explain why its important to listen to political leaders, etc.
But I think a couple of points deserve repeating.
From a push for vastly expanding federal involvement in preschool and early education to home visitations in the health care bills, the government remains intent on expanding its dominion (And hot on the heels of President Bush’s massive expansion of federal involvement in schools).
But this problem didn’t begin with Obama and won’t end with him. Politics in the schools is what we get when the government runs our schools.
Don’t want your kids indoctrinated by government bureaucrats, special interests, or the President?
Private school choice is the only remedy, and education tax credits are the increasingly popular and successful way to deliver it.
When will a critical mass of the people realize that it is dangerous and destructive to allow the government to control the education of our children and finally do something about it?

Evidence-based for Thee, But Not for Me
One of the things that strikes me as curious about supporters of the No Child Left Behind Act is that they talk regularly about “evidence” and having everything be “research-based,” yet they often ignore or distort evidence in order to portray NCLB as a success. Case in point, an op-ed in today’s New York Times by the Brookings Institution’s Tom Loveless and the Fordham Foundation’s Michael Petrilli.
Truth be told, the piece doesn’t lionize NCLB, criticizing the law for encouraging schools to neglect high-performing students because its primary goal is to improve the performance of low achievers. Fair enough. The problem is, Loveless and Petrilli assert with great confidence that the law is definitely doing the job it was intended to do. “It is clear,” they write, “that No Child Left Behind is helping low-achieving students.”
As you shall see in a moment, that is an utterly unsustainable assertion according to the best available evidence we have: results from the National Assessment of Educational Progress, which carries no consequences for schools or states and, hence, is subject to very little gaming. Ironically, Loveless and Petrilli make their indefensible pronouncement while criticizing a study for failing to use NAEP in reaching its own conclusions about NCLB.
So what’s wrong with stating that NCLB is clearly helping low-achieving students? Let me count the ways (as I have done before):
- Numerous reforms, ranging from class-size reduction, to school choice, to new nutritional standards, have been occurring at the same time as NCLB. It is impossible to isolate which achievement changes are attributable to NCLB, and which to myriad other reforms
- As you will see in a moment, few NAEP score intervals start cleanly at the beginning of NCLB – which is itself a difficult thing to pinpoint – making it impossible to definitively attribute trends to the law
- When we look at gains on NAEP in many periods before NCLB, they were greater on a per-year basis than during NCLB. That means other things going on in education before NCLB were working just as well or better than things since the law’s enactment.
So let’s go to the scores. Below I have reproduced score trends for both the long-term and regular NAEP mathematics and reading exams. (The former is supposed to be an unchanging test and the latter subject to revision, though in practice both have been pretty consistent measures.) I have posted the per-year score increase or decreases above the segments that include NCLB (but that might also include years without NCLB). I have also posted score increases in pre-NCLB segments that saw greater improvements than segments including NCLB. (Note that on 8th-grade reading I didn’t highlight pre-NCLB segments with smaller score decreases than seen under NCLB. I didn’t want to celebrate backward movement in any era.)
For context, NCLB was signed into law in January 2002 but it took at least a year to get all the regulations written and more than that for the law to be fully implemented. As a result, I’ll leave it to the reader to decide whether 2002, 2003, or even 2004 should be the law’s starting point, noting only that this problem alone makes it impossible to say that NCLB clearly caused anything. In addition, notice that some of the biggest gains under NCLB are in periods that also include many non-NCLB years, making it impossible to confidently attribute those gains to NCLB.
Please note that I calculated per-year changes based on having data collected in the same way from start to end. So some lines are dashed and others solid (denoting changes in how some students were counted); I calculated changes based on start and end points for the type of line used for the period. I also rounded to one decimal point to save space. Finally, I apologize if this is hard to read—I’m no computer graphics wizard—and would direct you to NAEP’s website to check out the data for yourself.
LA School District Vote Shows Further Cracks in Education’s Berlin Wall
America’s large urban school districts are often the lowest performing, least efficient, and most resistant to change. The poster children for this reality are perhaps Detroit and Washington, DC, but the Los Angeles Unified School District (LAUSD) has long been in the running as well.
Yesterday, there was a sign that LAUSD would like to get out of that race for the bottom: the district’s school board voted 6 to 1 in favor of a plan that would hand up to a third of its public schools over to private management. Ignoring for a moment the question of how well this policy will work, it is categorically, undeniably, a sign of change. In the past, such private contracting arrangements in large districts have usually been the result of state or mayoral takeovers. This is the first case that comes to mind in which the plan was the product of an elected school board that has just had enough with its own administrators’ unsatisfactory performance.
Keep in mind that school board elections suffer low-turnout, and that support for candidates is dominated by public school employee unions looking out for their own members’ salaries and job security. If THAT process can produce such a clarion call for parental choice, competition, and diversity in educational provision, times ARE changing.
Rose Friedman Passes
Rose Friedman, co-author of several books with her late husband and Nobel laureate economist Milton, passed away this morning. Rose and Milton co-wrote Free to Choose the wonderful book that formed the basis of Milton’s PBS television series, as well co-writing their joint auto-biography “Two Lucky People.”
She was intimately involved in the school choice movement both before and after Milton’s passing, as co-founder of the Milton and Rose D. Friedman Foundation for School Choice, ably led by Robert Enlow.
Rose and Milton were not just skilled economists who cared about kids, they were a charming couple. At a casual policy event a decade ago, they shared a single armchair to ensure that there would be enough seats for everyone. They weren’t just models of commitment to a worthy cause, they were models for how two smart, forthright people can build a marriage that lasts a lifetime.
Rose and Milton will long be remembered.
DC Residents Want Private School Choice
As Adam Schaeffer mentions below, a new poll commissioned by the Friedman Foundation and others reports that the vast majority of DC residents are in favor of the DC opportunity scholarships voucher program and are critical of the decision of congressional Democrats, President Obama, and ed. sec. Arne Duncan to phase out the program.
Many on the city council have already voiced their support for the program as well.
This begs a question: Why doesn’t the DC government just create its own private school choice program and save itself a boatload of money in the process?
DC spends about $28,000 per pupil on k-12 education right now. The federal vouchers, at an average of $6,600 each, are rather more cost effective, in addition to producing much better academic achievement after students have been in the program for a few years.
So most folks in DC want it. It would save the city massive amounts of money. And it would do great things for kids.
What are the mayor and the city council waiting for?
More Undeserved Praise for Obama’s NAACP Speech
Mike Petrilli of the Fordham Foundation is an affable and intelligent man. But he has gone round the rocker in regard to President Obama’s NAACP speech last week.
His review reads like promotional excerpts for a blockbuster movie; Don’t miss what critics are calling a can’t-miss experience . . . “transcendent” . . . “inspirational” . . . “honest, direct, bold.”
Why such superlatives? Because Obama is an “African-American president, speaking to the NAACP, and arguing for reform in our schools and responsibility in our homes and community.” Wow. Reform and responsibility?
Of course, as I point out here, the President OPPOSES the most direct and effective means of reforming education and empowering parents; school choice. And he supports expanding federal control of education from pre-k to college. Our President is working against reform and responsibility in education.
Our President has the nerve to lecture parents on the importance of getting involved as he supports ripping vouchers out of the hands of children in DC and elsewhere. He and his Congressional colleagues have effectively told thousands of District parents, who desperately want to direct their children to a better future, to shut up and sit down.
There is absolutely nothing to celebrate about a President who mouths nice platitudes while doing all he can to undermine the principles that underlie those sentiments.
Obama’s Audacious NAACP Speech
President Obama’s audacious — some might say condescending — speech to the NAACP yesterday leaves me cold. What’s most chilling is the speech comes from a person who opposes helping poor parents assume the most important responsibility of all, choosing the best school for their child.
From the president:
To parents, we can’t tell our kids to do well in school and fail to support them when they get home. For our kids to excel, we must accept our own responsibilities. That means putting away the Xbox and putting our kids to bed at a reasonable hour. It means attending those parent-teacher conferences, reading to our kids, and helping them with their homework. . .
It also means pushing our kids to set their sights higher. They might think they’ve got a pretty good jump shot or a pretty good flow, but our kids can’t all aspire to be the next LeBron or Lil Wayne. I want them aspiring to be scientists and engineers, doctors and teachers, not just ballers and rappers. I want them aspiring to be a Supreme Court Justice. I want them aspiring to be President of the United States.
This, from the man who supports killing the DC voucher program, the ONLY education reform empirically proven to work through multiple random-assignment studies. These are thousands of young lives we are talking about.
This, from a man who sends his daughters to one of the most expensive private schools in the country, rather than the miserably failing and unsafe schools in their backyard.
Education Tax Credits Pass in Indiana
Despite the economy and the dogged opposition of powerful Big Ed, education tax credits are surviving and thriving. The latest state to jump into k-12 tax credits is Indiana. From the Friedman Foundation yesterday:
Indiana lawmakers today approved a $2.5 million scholarship tax credit program in the home state of the Friedman Foundation for Educational Choice. The new scholarship program was inserted into the state’s budget and won approval in the late hours of the special legislative session. The bill, which passed the Senate 34-16 and the House 61-36, now goes to the governor who is anticipated to sign it in the coming days.
Unfortunately, the credit is only 50% for each dollar donated, unlike the more powerful ones in PA, FL, and AZ. But I know Friedman, School Choice Indiana and their allies will be fighting hard in coming years to increase the credit amount and program cap.
Sounds like Governor Mitch Daniels deserves kudos for keeping the bill in his budget and pushing for the program. And the word is that around 27 percent of the House Democrats voted for the budget despite the tax credit and virtual charter school programs that the teachers unions opposed. Big Ed ain’t what he used to be.
Propagandist Change
The Obama administration is taking down the “No Child Left Behind” schoolhouses in front of the U.S. Department of Education. According to Education Secretary Arne Duncan, the name is just too “toxic.” Besides, he’s got his own plan to manipulate the public’s cuteness zone. As the Washington Post reports, “photos of students, from preschool to college age, are going up on 44 ground-floor windows, forming an exhibit that can be seen from outside. There are images of young people reading, attending science class and playing basketball.”
So the propaganda is changing. The disaster that has been federal involvement in education, however, keeps rumbling along. Indeed, it seems poised to get even worse. The Obama folks have been mum about what, exactly, they have planned for reauthorization of the No Child Left…er…Elementary and Secondary Education Act, but the foreshadowing has been ominous: $100 billion in “stimulus” for already cash-drenched American education; loud endorsement of national standards; dangling $350 million to bankroll national (read: federal) tests; and the smothering of DC school choice.
So meet the new propagandist, same as the old propagandist…only, quite possibly, even worse.
Good Policy and Strategy in NJ
Chris Christie, the Republican candidate in New Jersey’s gubernatorial race this year, has some life in him. He’s going to hit incumbent Jon Corzine hard on the education issue and is making urban education reform and private school choice a central part of his platform.
Some highlights on Christie from the NYT:
He’s white, he’s conservative, and his support is strongest in New Jersey’s suburbs, where the public schools include some of the nation’s best.
Yet Christopher J. Christie, the Republican candidate for governor, is hunting for votes in cities like Newark, Camden and Trenton, where Democrats routinely pile up big margins, but where black and Hispanic parents are increasingly running out of patience with the public schools, among the nation’s worst…
But what could emerge as the sleeper issue is Mr. Christie’s push for education reform: merit pay for teachers, more charter schools, and above all, [education tax credits] as a way to give poor and minority children better educational choices and create competition that would improve the public schools…
Mr. Christie said that he did not expect to carry any heavily Democratic cities. But he is gambling that school choice has become popular enough among urban blacks and Latinos that he can cut into their support for Mr. Corzine, who opposes it.
Just a note: The article talks primarily about “vouchers,” but the private school choice plan being pushed there is a donation tax credit program. Reporters have difficulty with the distinction.

An Education Solution that’s Beyond Belief
Blogging for the Newark, N.J. Star-Ledger, politicial science prof. Thurman Hart presents this objection to school vouchers:
[T]he effect of it would be that state, and maybe federal funds, would be used for the expressed [sic] purpose of teaching Catholic dogma. My opposition to that has nothing to do with my status as an Episcopalian – I don’t want All Saints Episcopalian Day School in Hoboken to get state funds to teach Episcopalian dogma
There is merit to his concern. Many of this nation’s early immigrants had fled compelled support for religion and other infrigements on their freedom of belief in their mother countries. But there is a way to avoid these problems while simultaneously ensuring educational freedom and choice for all: education tax credits.
These programs cut taxes on families who cover the cost of their own children’s education, and on individuals and businesses who donate to non-profit scholarship funds for lower-income students. If you choose to participate, you also choose the institution that gets your money — either the school you send your own children to or the scholarship orgnization that receives your contribution. In the latter case, you simply pick the scholarship fund you think is doing the best job helping low-income families.
If you don’t want to fund a religious education for Catholics or Muslims, you don’t have to. You can choose a secular scholarship fund or one serving Episcopalians, Jews or Hindus. For those not particularly sensitive to the religiosity of other families’ schooling, there are scholarship funds that make no religious distinctions at all.
This is a way to unite like-minded donors and parents without the use of compulsion, and without inhibiting the very freedom and clear sense of mission that are the entire raison-d’etre of school choice. It is also in the best spirit of individual liberty and cooperation among free people that we will be celebrating early next month…
